A. 
There shall be an Office of the Sheriff, headed by a Sheriff. The election of the Sheriff, together with his or her term of office, shall be as provided in Article XIII of the New York State Constitution. At the time of his or her election and throughout his or her term of office, he or she shall be a qualified elector of the County.
B. 
Throughout his or her term of office, the Sheriff shall devote his or her whole time to the duties of his or her office and shall hold no other elective office. The Undersheriff, throughout his or her term of office, shall devote his or her whole time to the duties of his or her office and shall hold no elective office . Neither shall hold any other public office or be engaged in any employment or public or professional activity with any other governmental unit.

The Sheriff shall have and exercise all the powers and duties heretofore or hereafter lawfully granted or imposed by the Charter, this code, local law, ordinance or resolution of the County Legislature or by any applicable provision of any act of the State Legislature not inconsistent with those powers and duties vested in said office under the New York State Constitution. The Sheriff shall also perform such other related functions as the County Legislature or the County Executive may designate in order to implement and accomplish the policies and responsibilities the County Legislature has prescribed.

On or before March 1 of each year, the Sheriff shall make an annual report for the immediately preceding calendar year, covering generally the work of his or her Office. The Sheriff shall make such other reports at such times as may be required by the County Legislature, County Executive or any other applicable law. Copies of all reports shall be filed with the Clerk to the County Legislature and the County Executive.

The Sheriff shall appoint an Undersheriff and such deputies as shall be authorized by the County Legislature. The Undersheriff shall serve at the pleasure of the Sheriff.
B. 
The Undersheriff shall execute the powers and duties of the Office of the Sheriff in the absence or inability of the Sheriff to act. In the event that a vacancy occurs in the Office of the Sheriff, the Undersheriff shall execute the powers and duties of the Office until a new Sheriff has been duly elected or appointed and has qualified.
C. 
The Sheriff may, within the appropriations provided therefor, appoint jailers, jail matrons and such other officers and employees as may be necessary to operate the County Jail facilities.
D. 
The Sheriff or Undersheriff may deputize a person or persons in accordance with the applicable state law.
Whenever the Sheriff is required by law to transport a prisoner or any other person and the cost of the transportation is made a County charge by law, the Sheriff or Deputy Sheriff shall, within the appropriations provided therefor, be entitled to his or her necessary and actual disbursements incurred for travel, lodging and food.
Whenever it shall be necessary to keep together the members of a jury during their deliberations, the court may direct the Sheriff to furnish specified meals and/or lodging to such jury. The claim for expenses therefor shall be presented to the Commissioner of Finance. The claims must bear the approval of the Sheriff, Undersheriff or other deputy designated by the Sheriff to approve the same and of the Judge or Clerk of the court for which the jury was chosen. The claims shall be audited and paid as a County charge.
All moneys to which the County may be entitled under and by virtue of the laws of the State of New York or which the Sheriff may receive for services performed by his or her Office shall belong to the County and shall be collected by the Sheriff, accounted for and paid over to the Commissioner of Finance by a written statement within 10 days after the expiration of each month. Each monthly statement shall have attached thereto a certification by the Sheriff to the effect that the same is in all respects a full and true statement of all such moneys received by him or her for the preceding month. At the time of the rendering of any such statement, the Sheriff shall pay to the Commissioner of Finance all moneys received by him or her since the last preceding monthly statement. Other funds or fees collected by the Sheriff shall be paid over and reported to the Commissioner of Finance as above provided, except where otherwise specifically provided by statute.
The Sheriff, Undersheriff and such of his or her deputies, officers and employees as the County Legislature shall require shall each give a surety bond to the County in a sum fixed by the County Legislature, conditioned for the faithful performance of his or her duties. Such bond shall be approved as to form by the County Attorney and as to the sufficiency of surety by the County Executive and filed with the Department of Finance.
