The local enforcement agency shall enforce the Uniform Fire Safety Act[1] and the codes and regulations adopted under it in all buildings, structures, and premises within the established boundaries of the Township of Franklin, other than owner-occupied one- and two-family dwellings, except buildings owned or operated by the federal government, the State of New Jersey and interstate agencies, and shall faithfully comply with the requirements of the Uniform Fire Safety Act and the Uniform Fire Code.

A. 
Pursuant to § 11 of the Uniform Fire Safety Act (P.L. 1983, c. 383),[1] the New Jersey Uniform Fire Code and ICC New Jersey 2006 Edition shall be locally enforced in the Township of Franklin.

B. 
The Fire Marshal and deputies, if any, shall be appointed by the Township Committee of the Township of Franklin, such appointments shall be for one year, on a calendar basis.
C. 
A report of the Fire Marshal and the inspectors of the Township of Franklin shall be made annually to the New Jersey Division of Fire Safety as required; and copied to the Township Administrator.
Whenever the Fire Marshal shall disapprove an application or refuse to grant a permit applied for or when it is claimed that the provisions of the code do not apply or that the true intent and meaning of the code have been misconstrued or wrongly interpreted, the applicant may appeal from the decision of the Fire Marshal to the Construction Board of Appeals.
The Township Committee and the Fire Marshal, deputies, and inspectors shall act as a committee to determine and specify, after giving affected persons an opportunity to be heard, any new materials, processes or occupancies which shall require permits, in addition to those now enumerated in said code. The Fire Marshal shall post such list(s) in a conspicuous place on the bulletin board of the municipal building of the Township of Franklin and in his or her office, if any, and distribute thereof to interested persons.
A. 
Enforcement, violations, and penalties shall be managed in conformity with the Uniform Fire Safety Act,[1] and the Uniform Fire Safety Code and all other laws of the State of New Jersey.

B. 
Any penalties hereinbefore described which may be imposed for the violations of any provision of this article shall not limit or bar the Fire Marshal, the Township Committee or any person designated therefor from taking such other action or instituting such proceedings in any court of competent jurisdiction which shall be required to enforce the provisions of this article or which shall be empowered to enforce removal of prohibited conditions.
