It shall be unlawful for any person, firm or corporation to manufacture, store, barter, sell or discharge fireworks as a display of any kind or nature whatsoever, in the Township of Franklin, without first having obtained a license signed by all members of the Township Committee so to do.
Upon application being made by any person, firm or corporation for license permitting the manufacture, storage, barter, sale or discharge of fireworks as a display in the Township of Franklin, the Township Committee shall investigate the premises whereon it is contemplated to manufacture, store, barter, sell or discharge for display said fireworks, and shall not issue a license unless it shall ascertain that the property, lives and welfare of the inhabitants of the said township will not be hindered, harmed or jeopardized, and that the manufacture, storage, barter, sale or discharge for display of fireworks will not constitute a nuisance.
The Township Committee may impose such conditions, limitations and restrictions as it shall determine reasonable and proper, which shall be expressly stated in such permit, and also as a condition of any such permit, the Township Committee shall require a certificate of public liability insurance of an insurance company licensed to do business in the State of New Jersey, providing for property damage coverage of $25,000 and personal injury in the sum of $100,000 per person and $300,000 per accident, and the same shall be deposited with the Township Clerk of the Township of Franklin before any such permit shall issue. The Township Committee may waive this insurance requirement or require a lesser amount after a full investigation of the application.
Every person, whether as owner, agent, employee or otherwise, who shall be a party to the manufacture, storage, barter, sale or discharging for public display of fireworks within the limits of the Township of Franklin, without permit from the Township Committee as aforesaid, or who having furnished the required bond and obtained the required permit, shall manufacture, store, barter, sell or discharge for public display any fireworks in any place or manner, or under any conditions different from the conditions contained in the permit issued by the Township Committee, shall be deemed to have violated this chapter, and upon conviction thereof, shall, for each offense, be liable to a fine not exceeding $200 or imprisonment for a term not exceeding 60 days, or to both such fine and imprisonment, at the discretion of the Judge of the Municipal Court of the Township of Franklin, and the violation of this chapter for each separate day shall be and constitute a separate and distinct violation of this chapter.
