Designation of parking stalls for handicapped
drivers in each of the parking lots listed in Schedule A below[1] is hereby made in accordance with N.J.S.A. 40:48-2.46.

A.
No person shall park a vehicle in any of the designated
handicapped parking stalls in locations established herein unless
such person is a physically handicapped individual. Any vehicle parked
in a parking stall reserved for handicapped drivers which does not
display the official state handicapped license plate or special identification
stickers from the Division of Motor Vehicles shall be presumed to
have been parked in such stall unlawfully.
B.
For violations of this section, the offender shall
be liable to a fine of $250 and, for subsequent offenses, a fine of
at least $250 and up to 90 days' community service on such terms and
in such form as the court shall deem appropriate, or any combination
thereof.

A.
Designated parking spaces for handicapped drivers
shall be provided as close as possible to the route of travel to the
accessible principal entrance or entrances to the building.
B.
The owner of premises required to provide handicapped parking spaces as specified herein shall submit a sketch plan indicating the location of such spaces and the distance to the principal entrance or entrances to the building to the Zoning Officer within 30 days of the effective date of this article. The sketch plan shall be approved by the Zoning Officer prior to the installation of any handicapped spaces on any premises listed below. Any owner failing to submit the required sketch plan within the prescribed time shall be subject to penalties in accordance with § 254-43 of this article.
A.
The signing and pavement marking of handicapped parking
stalls shall conform to the specifications as prescribed by the New
Jersey Department of Transportation and the Manual on Uniform Traffic
Control Devices and shall be provided within 60 days from the date
approval is obtained from the Zoning Officer.
The owners of premises required to provide handicapped parking spaces shall also be required to install depressed curbing and/or ramps for parking lots to walkways leading to the principal entrance or entrances of the building. The location of the depressed curbing and/or ramps to be provided shall be shown on the sketch plan submittal required in § 254-42 of this article. The installation of ramps and depressed curbing shall be provided within the specified time for the installation of the required handicapped parking spaces as indicated in § 254-43A of this article. Failure to comply with this section shall constitute a violation for which an offender shall be subject to penalties in accordance with § 254-43B of this article.
The provisions of this article shall be enforced
by the Police Department of the Borough of Carteret.
All signing, pavement markings, depressed curbing and/or ramps shall be maintained in good and proper condition, including but not limited to the condition of required markings and signs, which should remain distinctly visible at all times. Any owner of premises required to provide handicapped parking stalls who shall fail to maintain such stalls in proper condition shall be subject to penalties in accordance with § 254-43B of this article.

Every request for a designated handicapped parking
stall within the Borough shall require an application fee not to exceed
$250, as may be permitted by law, with said amount to be set by resolution
of the governing body. The application fee shall be for the costs
of processing the application, engineering and/or police department
review and the installation of any signage and pavement marking of
any approved handicapped parking stall.
