As used in this chapter, the following terms shall have the meanings indicated:
EMPLOYEE
Any person appointed to any full- or part-time position of employment by the Borough of Jersey Shore; provided, that such person receives financial compensation from the Borough of Jersey Shore subject to withholding taxes by the state or federal government.
RESIDENCE
The actual domicile at which an individual primarily eats and sleeps and maintains a household.

A. 
Chief of Police, Sewage Treatment Plant Supervisors and Highway Supervisor. The Chief of Police, Sewage Treatment Plant Supervisor and Highway Supervisors are regarded as being essential emergency personnel whose presence within the Borough may be required at any time and on short notice. The Chief of Police, Sewage Treatment Plant Supervisor and Highway Supervisor shall establish and maintain residence either within the Borough of Jersey Shore corporate limits, or within five miles of the corporate limits of the Borough of Jersey Shore, at all times during their term of employment with the Borough of Jersey Shore.
B. 
All other employees. All employees of the Borough of Jersey Shore, including the Borough Manager and an Interim Borough Manager, excepting only the Chief of Police, Sewage Treatment Plant Supervisor and Highway Supervisor, shall establish and maintain residence either within the Borough of Jersey Shore corporate limits, or within 25 miles of the corporate limits of the Borough of Jersey Shore, at all times during their term of employment with the Borough of Jersey Shore.
All employees employed by the Borough of Jersey Shore prior to June 19, 1978, whose place of residence on the date of employment did not satisfy the conditions of this chapter, shall not be required to relocate their residence to satisfy the conditions of this chapter. In the event, however, that any such employee changes his or her residence subsequent to June 19, 1978, it shall be required that said employee establish residence in full compliance with the conditions of this chapter. All employees who are employed by the Borough of Jersey Shore on or after June 19, 1978, shall, within 90 days from the first date on which the employee reports to work, cause their residence to comply with the conditions of this chapter.
Every employee of the Borough of Jersey Shore, Pennsylvania, shall file annually, on such date as may be required by the Borough Manager, with the Borough Manager, a certificate stating the employee's name and place of residence. Such residence certificate shall be signed under penalty of perjury. The Borough Manager may also, from time to time, require proof of the bona fide residence of any employee of the Borough, to determine said employee's eligibility to receive financial compensation from the Borough.
Failure to comply with the conditions of this chapter shall subject the employee to termination of employment and to termination of all benefits of employment.
