The Borough Zoning Officer, or such others designee(s) appointed by the Borough, is hereby appointed as the designated officer who is authorized to carry out all responsibilities and duties stated herein, said future appointments being done by resolution hereafter.
A. 
Bonds for demolition of structures will be required in the following events:
(1) 
A total demolition of a dwelling or commercial structure.
(2) 
Demolition of 50% or more of a dwelling or commercial structure.
(3) 
Demolition of an accessory structure greater than 1,000 square feet.
B. 
Bond amounts will be in the amount equivalent to the cost of demolition.
C. 
The bond can be an irrevocable letter of credit, a bond issued by a licensed and approved bonding company, cash, or certified check in the amount determined in Subsection B above.
D. 
Bonding is required to ensure completion of the demolition projects as well as ensuring the demolition project is done correctly. If it is not, then Jersey Shore Borough is authorized to collect the bond and use the funds to complete and/or correct the demolition.
E. 
Demolition projects must be completed in 30 days unless extended by the Zoning Officer.
F. 
A bond, as described hereinabove, is required prior to the issuance of a permit for demolition.
G. 
Demolition shall be defined through the Building Code in effect at the time of the demolition permit application, or by any applicable ordinance in effect at the time.
The Council of the Borough may, by resolution, adopt procedures and regulations to implement this article and may fix reasonable fees to be charged for municipal activities.
Any owner(s) of property, and any individual(s) or entity subject to this article, if in violation of this article, shall be subject to a penalty of up to $1,000 per violation, together with costs of prosecution, and, in default of payment of such fines and costs, to imprisonment for not more than 30 days. Each day the violation occurs shall be deemed to be a separate offense.
The provisions of this article shall be severable and, if any of the provisions hereof shall be held to be invalid or unenforceable, the remaining provisions of this article shall remain in effect.
All ordinances or parts of ordinances conflicting with any of the provisions of this article are hereby repealed insofar as same affect this article.
This article shall become effective within 30 days.
