As used in this Code and in all ordinances subsequently enacted
by the Board of Aldermen of this City, unless it is otherwise specifically
provided or unless it is plainly repugnant to the intent of the Board
or the context of the ordinance, Chapter or Section:
BOARD, MAYOR, CLERK, CHIEF OF POLICE
The term "the Board" shall mean the Board
of Aldermen of the City of Plattsburg, Missouri; the term "the Mayor" shall mean the Mayor of the City of Plattsburg,
Missouri; the term "the Clerk" shall mean the City
Clerk of the City of Plattsburg, Missouri; and the term "the
Chief of Police" shall mean the Chief of Police of the City
of Plattsburg, Missouri.
CITY, COUNTY, STATE
The term "the City" shall mean the City
of Plattsburg, Missouri; the term "the County", shall
mean the County of Clinton; and the term "the State" shall mean the State of Missouri.
GENERAL ELECTION
The election required to be held on the first (1st) Tuesday
of April.
HERETOFORE, HEREAFTER, PRECEDING, FOLLOWING
The term "heretofore" shall mean any time
previous to; the term "hereafter" shall mean any
time after; the term "preceding" shall mean next
before; and the term "following" shall mean next
after.
MAJORITY MAY ACT FOR ALL
Words importing joint authority to three (3) or more persons
shall be construed as authority to a majority of the persons, unless
the ordinance declares otherwise.
MONTH, YEAR
The term "month" shall mean a calendar month,
and the term "year" shall mean a calendar year.
MUNICIPAL CODE
The terms "revised ordinances", "this code", "this
revision, or "the revision" shall mean The
Municipal Code of Plattsburg, Missouri.
OATHS AND AFFIRMATIONS
Whenever any ordinance shall require that any person be administered
any oath or swear to any matter it shall be construed to include an
affirmation in all cases in which by law, an affirmation may be substituted
for an oath, and in such cases the words "swear" and "sworn" shall
be equivalent to the words "affirm" and "affirmed".
OWNER, TENANT
The term "owner" shall include any part
owner, joint owner, tenant in common, joint tenant, or tenant by the
entirety and the terms "tenant" or "occupant" shall include any person who occupies the whole or a part of a building
or land whether alone or with others.
PERSON
Shall extend to and include bodies politic and corporate,
and to partnerships and other unincorporated associations.
POWER OF DEPUTIES
When an ordinance requires an act to be done, which by law,
an agent or deputy as well may do as the principal, the requisition
is satisfied by the performance of the act by an authorized agent
or deputy.
PROPERTY, REAL PROPERTY, PERSONAL PROPERTY
The term "property" shall include both real
and personal property; the terms "real property", "premises",
"real estate", or "lands" shall be deemed
to be co-extensive with lands, tenements and hereditaments; the term "personal property" shall include tangible and intangible
personal property; the term "tangible personal property" shall include money, goods, and chattels; and the term "intangible
personal property" shall include all choses in action, and
evidences of debt.
PUBLIC WAY, STREET, SIDEWALK
The term "street" or "public way" shall include any street, alley, boulevard, parkway, highway, sidewalk
or other public thoroughfare; and the term "sidewalk" shall mean that portion of the street between the curb line and
the adjacent property line, intended for the use of pedestrians.
RESIDENCE
A person shall be deemed to reside at the place where his
family shall permanently reside or at the place where a person having
no family shall generally lodge.
SIGNATURE
Where the written signature of any person is required, the
proper handwriting of such person or his mark shall be intended.
TIME, COMPUTATION OF
The time within which an act is to be done shall be computed
by excluding the first day and including the last. However, if the
last day is Sunday or a legal holiday, it shall be excluded and the
time extended to the next succeeding day, not a holiday.
WORDS AND PHRASES
Words and phrases shall be taken in their plain or ordinary
and usual sense, but technical words and phrases having a particular
and appropriate meaning in law shall be understood according to the
technical import. Whenever any subject matter, party, or person is
described or referred to by words importing the singular number, several
matters and persons are included, and whenever any words importing
the plural number are used, any single matter, party, or person is
included. Whenever any party or persons is referred to by words importing
the masculine gender, females are also included. Words used in the
past or present tense include the future, as well as the past and
present.
WRITING
The words "writing" and "written" shall include printing, lithographing or other mode of representing
words and letters.
