The following words, for the purpose of this chapter, shall have the meanings hereby respectively ascribed thereto, except where the context clearly indicates a different meaning:
PORTABLE ON-DEMAND CONTAINERS (PODS®)
Any boxlike structure or container, made of any material, which has as its purpose the temporary storage of residential or commercial items on any public or private property in Stowe Township.
No person, firm, partnership, corporation or other entity shall, at any time, locate on any private or public property in the Township of Stowe any portable on-demand (PODS®) storage container that is used for the storage of residential, household or commercial items on public or private property in the Township of Stowe without first having procured a license therefor as hereinafter provided in this chapter.
Applications for the license hereby required shall be made to the Board of Township Commissioners, through the Township Secretary. The Board of Township Commissioners shall have the authority before granting any such license to inspect the public or private property on which the portable on-demand storage device is intended to be located. The Board shall have authority to refuse to grant such license if it shall deem such refusal to be in the interest of the health, safety, welfare and/or morals of the Township and its inhabitants. If the Board shall see fit to grant such license, the applicant shall pay to the Township Secretary, for the use of the Township, a license fee as established by resolution by the Board of Commissioners.
It shall be unlawful for any person, partnership, association, firm or corporation to store a portable on-demand storage container after the expiration of 30 days.
The Board of Township Commissioners shall have authority to revoke any license issued thereunder under this chapter when the Board shall deem such revocation to be in the interest of health, safety, welfare and/or morals of the Township and the inhabitants thereof. In case of revocation, no part of any license fee required hereunder shall be refunded.
Any person, firm, partnership, association, firm or corporation who shall violate any provisions of this chapter shall, upon conviction thereof for each any every such violation, be sentenced to pay a fine of not more than $100, and costs of prosecution, provided each day on which a violation of any provision of this chapter shall be committed shall constitute a separate violation.
