It shall be unlawful for any group of more than four persons to use the parks within the Borough of Churchill for holding a picnic, outing or any type of gathering unless a park permit shall first be obtained from the Secretary of the Borough of Churchill, upon presentation of proper identification. The park permit shall include the following statement:
"By applying for a permit, applicant(s) agree to indemnify and hold harmless the Borough of Churchill, its Boards, officials and employees from any and all claims and expenses which may arise from applicant's use of the premises/park. In addition, applicant shall be responsible for all costs covering damage of facilities or equipment. Failure to secure a permit will be considered trespassing, punishable under state law."

A. 
A refundable key deposit fee as set forth in Chapter A315, Fee Schedule, only shall be charged to Churchill residents or nonprofit groups [scout troops, Association for Retired Persons (AARP), etc.]
B. 
A as set forth in Chapter A315, Fee Schedule, including a refundable key deposit, shall be charged by the borough for each picnic, outing or gathering permit which shall be paid to the Borough Secretary at the time of application. Provided, however, that in the event the permit shall be refused for any reason adversely affecting the public safety and welfare, the said fee shall be refunded. The key deposit shall be refunded only after inspection finds the facilities and equipment in good order. Additional fees shall be levied, if necessary, to cover damage of facilities or equipment.
A set of rules and regulations pertaining to the use of Churchill Borough parks shall be appended to and be considered as an integral part of this chapter.[1] A copy of these rules and regulations shall be given to each park permit applicant and said applicant will be responsible for the obeisance to the rules and regulations by the entire group.
A police officer(s) shall be assigned to visit such groups from time to time to assure the maintenance of peace and good order and for the regulation of traffic in the vicinity thereof.

Any person(s) violating any of the provisions of this chapter, upon conviction therefor, shall be subject to the payment of a fine of not exceeding $600, plus costs of restoration and costs of prosecution, and, in default of paying said fine and costs, shall be committed to the county jail or other lockup provided by this borough for a period not exceeding 30 days.
Churchill Borough Parks
Rules and Regulations
A.
Park hours are from 8:00 a.m. to sunset every day. Additional hours may be granted by the Borough Manager if appropriately requested.
B.
A permit from the Churchill Borough Office, 2300 William Penn Highway, is required for use of the parks by any group of more than four people.
C.
Dogs and other pets must be on a leash or in a cage at all times. Owners are responsible for cleaning up after their pets and disposing of their pet's wastes in a sanitary (toilet) facility.
D.
The following are PROHIBITED:
(1)
Excessive noise.
(2)
Removal or destruction of vegetation, trails, buildings, structures or equipment
(3)
Bicycles, minibikes, dirt-bikes, go-carts, snowmobiles and motorcycles.
(4)
Overnight camping.
(5)
Parking in other than designated areas.
(6)
Use of the stream (Chalfant Run) for recreation or consumption.
E.
Hunting, trapping, discharging of firearms, air guns, bows and arrows, sling shots, explosives, fireworks or any missiles is prohibited and punishable under the Crimes Code.
F.
Persons obtaining the key for locks on the storage shed, toilets or water vault must make certain that:
(1)
The lamps in the shelters are removed and returned to the storage shed.
(2)
Electric service is shut off.
(3)
The water valve is closed.
(4)
The toilets are left in a clean and sanitary condition.
(5)
All locks are replaced and secured.
G.
Tables must not be moved unless special arrangements are made with the borough office.
H.
All fires must be confined to charcoal grills and designated fire pits and must be completely extinguished before leaving the area.
I.
Trash, garbage and other litter must be placed in containers provided for this purpose and shall be limited to items accumulated during use of the parks.
J.
Violators of any or all of the above rules and regulations will be subject to the penalties described in § 228-5 of the Code of the Borough of Churchill.
