A. 
In compiling and preparing the legislation for adoption and revision as part of the Code pursuant to § 20 of the Municipal Home Rule Law, as amended, certain grammatical changes and other minor changes where made in one or more pieces of said legislation. It is the intention of the Board of Trustees of the Village of Garden City that all such changes be adopted as part of the Code as if the ordinances so changed had been previously formally amended to read as such.
B. 
In addition, the following changes, amendments or revisions are made herewith, to become effective upon the effective date of this local law. (Chapter and section number references are to the legislation as it has been renumbered and appears in the Code.)
(1) 
In Chapter 31, Officers and Employees, Article I, Eligibility for Appointment, § 31-1 (former Section 1 of L.L. No. 1-1969) is amended to change the phrase "twenty-one years of age" to "18 years of age" in conformance with the Village Law of New York State.
(2) 
In Chapter 137, Lost and Found, § 137-1C (former Ord. No. 8.1 of the Revised Unified Code of Ordinances) is amended by adding the words "or certified" between the words "registered" and "mail."
(3) 
In the following chapters and sections the terms "Superintendent of Utilities and Engineering" or "Superintendent of Public Works" are amended to read "Director of Public Works" to conform to current Village governmental structure:
(a) 
Chapter 80, Cesspools, §§ 80-1 and 80-2 (former Ord. No. 4.2 of the Revised Unified Code of Ordinances).
(b) 
Chapter 115, Garbage, Rubbish and Refuse, §§ 115-1B, 115-5E, 115-7, 115-8B, 115-10A [former Sections (a), (e), (g), (h), (j) and (k) of Ord. No. 4.1 of the Revised Unified Code of Ordinances].
(c) 
Chapter 123, Health Nuisances, Article I, Vacant Land; Stagnant Water, §§ 123-2 and 123-3 [former Sections (b) and (c) of Ord. No. 4.3 of the Revised Unified Code of Ordinances].
(d) 
Chapter 160, Poles and Wires, § 160-1 (former Ord. No. 1.8 of the Revised Unified Code of Ordinances).
(e) 
Chapter 178, Streets and Sidewalks, §§ 178-9 and 178-10 [former Sections (a) and (b) of Ord. No. 1.6 of the Revised Unified Code of Ordinances]; § 178-23 (former Ord. No. 7.5 of the Revised Unified Code of Ordinances).
(f) 
Chapter 188, Trees, §§ 188-1, 188-2 and 188-3 (former Sections 1, 2 and 3 of Ord, No. 1.11 of the Revised Unified Code of Ordinances) and § 188-8B [former Section (c) of Ord. No. 4.5 of the Revised Unified Code of Ordinances].
(4) 
In the following chapters and sections the term "Department of Utilities and Engineering" is amended to read "Department of Public Works" to conform to current Village governmental organization:
(a) 
Chapter 103, Fire Hydrants, § 103-2 [former Section (b) or Ord. No. 3.1 of the Revised Unified Code of Ordinances].
(b) 
Chapter 178, Streets and Sidewalks, § 178-16 (former Ord. No. 1.10 of the Revised Unified Code of Ordinances).
(5) 
In the following sections of Chapter 178, Streets and Sidewalks, the term "Department of Utilities and Engineering" is amended to read "Director of Public Works": § 178-14A and 178-15 [former Sections (c) and (d) of Ord. No. 1.9 of the Revised Unified Code of Ordinances].
(6) 
In Chapter 70, Buildings, Moving of, § 70-3 [former Section (c) of Ord. No. 1.7 of the Revised Unified Code of Ordinances] is amended to raise the application fee to "$100"; the liability insurance required to "five hundred thousand dollars/one million dollars ($500,000,/$1,000,000.)"; the property damage insurance required to "$200,000"; and the street protection insurance required to "$10,000."
C. 
Penalties. In addition to the foregoing amendments, certain sections of the local laws and ordinances of the Village of Garden City, are hereby amended by deleting specific penalty provisions and substituting a reference statement indicating that offenses are punishable as provided in Chapter 1, General Provisions, Article II, Penalties for Offenses. These sections are as follows:
(1) 
Section 75-12 [former Section (c) of Ord. No. 6.9 of the Revised Unified Code of Ordinances, adopted 7-14-1977] concerning business licenses.
(2) 
Sections 127-44 and 127-45 (former Sections 1.1 and 1.2 of Article VII of the Housing Code, adopted 10-5-1967).
(3) 
Section 170-8 [former Section (h) of Ord. No. 1.12 of the Revised Unified Code of Ordinances] concerning shopping carts.
(4) 
Section 197-6C (former Subsection 6.3 of L.L. No. 8-1977, adopted 9-1-77) concerning control of backflow and cross-connections.
D. 
Repeal of conflicting penalty provisions. The following ordinances, or parts thereof, and parts of certain local laws of the Village of Garden City are hereby repealed, as of the effective date hereof, to conform to the General Penalty established in § 1-12 hereof:
(1) 
Section 7 of Local Law No. 3-1978, adopted 4-20-1978.
(2) 
Section (h) and the second paragraph of Section (m) of Ord. No. 5.6 of the Revised Unified Code of Ordinances.
(3) 
Section 3 of Local Law No. 1-1978, adopted 1-5-1978.
(4) 
Section 4 of Local Law No. 7-1977, adopted 7-14-1977.
(5) 
The second paragraph of Ord. No. 8.1 of the Revised Unified Code of Ordinances.
(6) 
Ordinance Nos. 1.14, 2.12, 3.8, 4.8, 5.16 and 6.8 of the Revised Unified Code of Ordinances.
(7) 
Section 11 of Local Law No. 3-1979, adopted 9-6-1979.
(8) 
Section 7 of Local Law No. 1-1981, adopted 1-8-1981.
(9) 
Section 15 of Local Law No. 2-1981, adopted 1-8-1981.
(10) 
Section 11 of Local Law No. 7-1981, adopted 12-17-1981.
If any clause, sentence, paragraph, section, Article or part of this local law or of any local law, ordinance or resolution cited in the table in § 1-1B hereof, or of any local law, ordinance or resolution incorporated into the Code hereafter shall be adjudged by any court of competent jurisdiction to be invalid, such judgment shall not affect, impair or invalidate the remainder thereof but shall be confined in its operation to the clause, sentence, paragraph, section, Article or part thereof directly involved in the controversy in which such judgment shall have been rendered.
The provisions of this local law are hereby made Chapter 1 of the Code of the Village of Garden City, to be entitled "Chapter 1, General Provisions," and the sections of this local law shall be numbered §§ 1-1 through 1-18.
This local law shall take effect as provided by law upon filing with the Secretary of State of the State of New York.
