Editor's Note: Original § 2 of this local law provided that it "be submitted for approval of the electors at a special election to be held within sixty days after its adoption and if approved by the affirmative vote of a majority of the qualified electors of the village voting on the proposition for its approval, it shall take effect February first, nineteen hundred sixty-five." Local Law No. 2-1965 was approved at the special election held 1-5-1985.

Section 4-412, Subdivision 2, of the Village Law, as it applies to the Village of Garden City, is hereby changed, superseded and amended to read as follows:
§ 4-412 The board of trustees
2.  Procedure for meetings. The Mayor of the village shall preside at the meetings of the Board of Trustees and may vote on all matters and questions coming before the Board. In case of a tie, the Mayor shall vote, and such vote shall be counted as an additional vote on any matter or question as to which the Mayor may have voted previously. For the purpose of determining whether a tie exists, absences and abstentions shall be considered negative votes. The Mayor and four Trustees, or five Trustees without the Mayor, shall constitute a quorum for the transaction of business, but a lesser number may adjourn and compel the attendance of absent members. Whenever required by a member of the Board, the vote upon any question shall be taken by ayes and noes, and the names of the members present and their votes shall be entered in the minutes. The Board may determine the rules of its procedure and may compel the attendance of absent members by the entry of a resolution in the minutes directing any peace officer residing within the village to arrest such absent member and take him before the Board of Trustees to answer for his neglect. A copy of the resolution, certified by the Clerk of the village, shall be sufficient authority to any peace officer residing in the village to arrest such absent member and bring him before the Board.

The annual meeting of the Board of Trustees shall take place at 8:00 p.m. on the first Monday in the month following the annual village election.
The Board of Trustees shall hold regular meetings at such times and places in the village as it shall by resolution provide.
Special meetings of the Board of Trustees may be called by the Mayor or, in his absence, the Deputy Mayor or by any two Trustees. Written notice specifying the time and place thereof shall be served on each member of the Board as follows:
A. 
By causing such notice to be served personally on such member at least one hour before such meeting;
B. 
By leaving such notice at the residence or place of business of such member with a person of suitable age and discretion at least 24 hours before such meeting; or
C. 
By mailing such notice to the residence or place of business of such member at least 72 hours before such meeting.
