The Division of Purchasing shall be headed by a Director. The method of choosing the Director shall be as provided in § C3.02, Subsection (w), of Article III of the Charter. The qualifications of the Director of Purchasing shall be as follows:
A. 
At least eight years of experience in the purchase of supplies and equipment, the preparation of materials and services specifications or retail sales involving pricing or cost analysis of items or goods; or
B. 
Graduation from a regionally accredited or New-York-State-registered college or university with a bachelor's degree in business administration, retail sales management, marketing or a closely related field and four years of experience as noted above; or
C. 
An equivalent combination of training and experience as defined by the limits of Subsections A and B above.
A. 
The Director of Purchasing shall have all the powers and duties and shall be subject to all the obligations and liabilities heretofore or hereafter lawfully granted or imposed by the Charter, this code, local law, ordinance or resolution of the County Legislature or any applicable provision of any act of the State Legislature not inconsistent with the Charter or this code. The Director of Purchasing shall also perform such other related functions as the County Legislature or the County Executive may designate in order to implement and accomplish the policies and responsibilities the County Legislature has prescribed.
B. 
The Director of Purchasing shall also:
(1) 
Establish and maintain a centralized purchasing system.
(2) 
Prepare and maintain purchasing policy and procedures for a centralized purchasing system.
(3) 
Make all purchases and sales of materials, supplies, services and equipment and contract for the rental and servicing of the equipment for all departments of the County in accordance with requirements as to advertising and competitive bidding as set forth by applicable law.
(4) 
Establish and enforce standard specifications with respect to supplies, services, materials and equipment.
(5) 
Determine the quality, quantity and conformity to contract or purchase order of supplies, materials and equipment delivered.
(6) 
Accept or reject deliveries which do not conform to specifications.
(7) 
Establish and maintain a procedure and have the authority to transfer supplies, materials and equipment between departments, offices and agencies.
(8) 
Sell or lease any surplus, obsolete or unused supplies, materials and equipment under such rules and regulations as may be established by resolution of the County Legislature.
(9) 
Upon the request of any Town, Village, school district or any other unit of local government, act as purchasing agent for same, either for all or for any part of its purchases, upon such conditions as may be prescribed by the County Legislature.
(10) 
In accordance with § C3.02, Subsections (u) and (w), of the Charter, the County Executive is empowered to delegate to the director the power to execute all contracts on behalf of the County with respect to the buying and selling of any supplies, services, materials or equipment, subject to the provisions and requirements of the General Municipal Law of the State of New York.
(11) 
Perform, under the direction of the County Executive, all other duties of a County purchasing agent under laws of the State of New York not inconsistent with the provisions of this code.
(12) 
Arrange for the purchase of supplies, services, materials or equipment for the County in accordance with the following: The amount fixed by the General Municipal Law of the State of New York, as said amount may be from time to time amended, is hereby fixed as the monetary limit above which any purchases or contract of purchases of supplies, materials and equipment shall not be made without public bidding.
C. 
The Director of Purchasing may purchase supplies, services, materials or equipment without the advertisement and public bidding required by this section if the County Executive, acting together with the Chairperson of the County Legislature, has declared a public emergency arising out of an accident or other unforeseen occurrence whereby circumstances affecting public buildings, public property or the life, health, safety or property of inhabitants of the County of Rockland require immediate action which cannot await competitive bidding.
D. 
All purchases shall be initiated by written requisitions signed by an authorized person and filed with the Division of Purchasing.
E. 
No supplies, services, materials or equipment shall be purchased by any County officer or employee unless specifically authorized and approved by the Director of Purchasing, except pursuant to written regulations of the Director of Purchasing.
F. 
No purchase of supplies, services, materials, equipment or service contracts shall be made, subscribed, delivered or furnished until the Director of Purchasing has certified that they are official County purchases or contracts and that funds have been encumbered.
G. 
The Director of Purchasing shall also perform such other and related duties as the County Legislature, the County Executive, and the Commissioner of General Services may require.
On or before March 1 in each year, the Director of Purchasing shall make an annual report for the immediately preceding calendar year, covering generally the work of the Division of Purchasing. The Director shall make such other reports at such times as may be required by the County Legislature, County Executive or any other applicable law. Copies of all reports shall be filed with the Clerk to the County Legislature and the County Executive.
The County Legislature shall have the power, by resolution, local law or ordinance, to establish such rules, regulations and charges not inconsistent with law relating to the Division of Purchasing, and such rules, regulations or charges so established shall become valid upon being filed with the Clerk to the Legislature, the County Executive, the Director of Purchasing, the Department of Records and the Commissioner of General Services.
The Director of Purchasing, and such of his or her deputies, officers and employees as the County Legislature shall require, shall each give a surety bond to the County conditioned for the faithful performance of his or her duties. Each bond shall be approved as to form by the County Attorney and as to the sufficiency of surety by the County Executive and filed with the Department of Records.
A. 
The Director of Purchasing, within the appropriations provided therefor, shall appoint such officers, assistants and/or employees in his or her Division, including such actual deputy positions as may be authorized and budgeted, as shall be authorized by the County Legislature. All deputy Directors of Purchasing shall serve at the pleasure of the Director of Purchasing, subject to all applicable provisions of New York State law.
B. 
The Director of Purchasing shall designate and deputize a deputy or deputies to whom shall be delegated all the powers and duties of the Director of Purchasing and the authority to act generally for and in place of said Director of Purchasing.
C. 
The designation or designations shall be in writing and shall designate the relative rank of the deputies, including the order of temporary succession to the duties of the Director of Purchasing during absence, disability or otherwise and also may delegate among them such powers and duties as he or she may determine. The designations and delegations shall be in writing and filed in the Department of Records, and copies thereof shall be filed with the Commissioner of General Services, the Clerk to the County Legislature and with the County Executive.
