There is hereby adopted and incorporated herein, in its entirety, the provisions of N.J.S.A. 26:1A-7 et seq. and the provisions of N.J.A.C. 8:26.1 through 8:26-8.9, as the same is or may be amended or supplemented.
No person shall operate a public bathing place within the Borough of Wanaque unless a license(s) to operate the same shall have been issued by the Board of Health. Said license shall be posted in a conspicuous place at the facility. Said license shall not be transferable and shall expire on December 31 following the date of issuance.
The fee for said license or license approval issued pursuant to this action shall be established as follows:
A. 
Public beach: two hundred dollars ($200.).
B. 
Public hot tub or spa: twenty dollars ($20.).
C. 
Public swimming pool: forty dollars ($40.).
D. 
Public wading pool: twenty dollars ($20.).
The Board of Health shall have the right, in addition to other penalties herein provided under the existing state statutes and regulations, and the provisions of this chapter, to deny, revoke or suspend a license for noncompliance.
Each violation of this chapter shall constitute a separate offense and shall be punishable by a civil penalty of not less than twenty-five dollars ($25.) nor more than five hundred dollars ($500.) and such other criminal penalties as may be provided by law (see N.J.S.A. 26:1A-10).
