It is the purpose of this article to modify the requirements of Section 23 of the Town Law and Section 3 of the Public Officers Law, which sections require that the Assistant Court Clerk be a resident and elector within the Town by amending Chapter 43 of the Code to include Article VII thereof entitled Residency Requirements for Assistant Court Clerk.
This article is enacted pursuant to the provisions of Section
10 of the Municipal Home Rule Law.
"A local law to amend residency requirements for the Assistant
Court Clerk of the Town of Somers."
In the Town of Somers, Westchester County, the provisions of
this section requiring a person to be a resident of the political
subdivision or municipal corporation of the state for which she shall
be chosen or within which her official functions are required to be
exercised shall not prevent a person from holding the office of Assistant
Court Clerk of the Town of Somers, provided that such person resides
within the State of New York.
This article shall take effect upon filing with the State of
New York.
