This ordinance shall be known as "An Ordinance Prohibiting Smoking Within 25 feet of the Entrance to City Buildings."
For purposes of this ordinance, the City Council adopts the following definitions:
CITY
The City government of Lincoln, Arkansas.
CITY BUILDING
Any enclosed, indoor area which is owned, leased, or controlled by the City, including, but not limited to, offices or other work areas, restrooms, and rooms in which a public meeting, hearing, or other official proceeding open to the public is in progress.
SMOKING
Holding a lighted pipe, cigar, or cigarette of any kind, or lighting, or emitting or exhaling the smoke of, a pipe, cigar, or cigarette of any kind, and also includes the use of any tobacco or tobacco derivatives that are designed for smoking, vaping, inhaling without smoking and electronic cigarettes.
Smoking is hereby prohibited within 25 feet of the entrance to each and every building owned or building space leased by City government.
Signs shall be posted at each public entrance to all City buildings informing both employees and the public that smoking within the prescribed distance is prohibited.
The City Council intends that the provisions in this ordinance shall be in addition to, and not instead or derogation of, any currently applicable law or regulation restricting the use of tobacco within the City limits of Lincoln, Arkansas, including but not limited to the Arkansas Clean Indoor Air Act of 2006 (currently codified at A.C.A. §§ 20-27-1801 through 1809) and the City's Personnel Policy, dated February 2017.
