Editor's Note: This ordinance included an emergency clause that provided as follows: "The City Council finds that there are no current restrictions on tethering animals and regulations on animal trolley systems. The City Council finds that proper restriction, especially in the summer months, is critical to life in an incorporated city. Therefore, the City Council hereby finds and declares that this ordinance is of such urgent and pressing business that an emergency is declared to exist, and that this ordinance shall be effective immediately upon its passage."
This ordinance shall be known as "An Ordinance Prohibiting the Unattended Tethering of Animals within the City Limits, Regulating Animal Trolley Systems, Declaring an Emergency and for Other Purposes."
As used in this ordinance:
TETHER
The attachment of an animal, or the animal's collar or harness, to a fixed point such as a structure, stake, pole, fence or tree by means of a chain or rope.
TROLLEY SYSTEM
A confinement system utilizing cables and a pulley. Only one animal may be on each trolley system. The cable must be attached to a properly fitting collar or harness and of at least eight feet in length. The trolley cable must be fixed to two permanent points and no less than 10 feet long and mounted four to seven feet off the ground. There must be a swivel on at least one end of the affixed cable to prevent entanglement and have the ability to slide on the horizontal cable with a stop at each end. No obstructions shall be in the trolley area. The system shall provide adequate room for normal postural adjustments, for exercise and access to water, food, and shelter.
It shall be unlawful for any person to tether an animal as a means of confining or restricting the movement of the animal unless there is, at all times the animal is tethered, a person over the age of 12 years physically present with the animal and within eyesight and earshot of the animal.
The use of a trolley system, whether attended or not by a human, that meets the requirements defined above, is hereby expressly permitted. It is unlawful for any person to use any trolley system that does not meet all of the criteria defined above as a means of confining or restricting the movement of an animal. No trolley system will be permitted past the front building line of the primary structure.
