[HISTORY: Adopted by the Township Committee of the Township
of Delaware 7-28-1986 by Ord. No. 1986-15 as Ch. VII of the 1985 Revised
General Ordinances. Amendments noted where applicable.]
Whenever any words and phrases are used in this chapter, the
meaning respectively ascribed to them in Subtitle I of Title 39 of
the Revised Statutes of New Jersey shall be deemed to apply to such
words and phrases used herein.
Whenever certain hours are named in this chapter, they shall
mean either Eastern standard time or Eastern daylight saving time
as may be in current use in the Township.
The provisions of this chapter imposing a time limit on parking
shall not relieve any person of the duty to observe other more restrictive
provisions prohibiting or limiting the stopping, standing or parking
of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey
Statute or as hereinafter provided.
A. Upon the declaration of an emergency, there shall be no parking upon
streets or sections of streets where temporary "EMERGENCY NO PARKING"
signs are displayed. The Chief of Police or, in his absence, the ranking
police officer is authorized to declare an emergency and to direct
the posting of "EMERGENCY NO PARKING" signs when weather conditions,
accidents, fire or public celebrations dictate or require the avoidance
of hazards or other conditions which interfere with the free flow
of traffic. Notification that "EMERGENCY NO PARKING" signs are being
or will be posted shall be given to the operator or owner of any vehicle
which has been parked prior to the posting of the signs.
B. Any unoccupied vehicle parked or standing in violation of this section
shall be deemed a nuisance and menace to the safe and proper regulations
of traffic and any police officer may provide for the removal of such
vehicle. The owner shall pay the reasonable costs of removal and storage
which may result from such removal before regaining possession of
the vehicle.
C. The effectiveness of this section is contingent upon the signs being
erected as required by law.
No person shall park a vehicle at any time upon any of the streets
or parts thereof described in Schedule I attached to and made a part
of this chapter.
No person shall park a vehicle between the hours specified in
Schedule II of any day (except Sundays and public holidays) upon any
of the streets or parts of streets described in Schedule II attached
to and made a part of this chapter.
No person shall stop or stand a vehicle between the hours specified
in Schedule III of any day (except Sundays and public holidays) upon
any of the streets or parts of streets described in Schedule III attached
to and made a part of this chapter.
No person shall park a vehicle for longer than the time limit
shown in Schedule IV at any time between the hours listed in Schedule
IV of any day (except Sundays and public holidays) upon any of the
streets or parts of streets described in Schedule IV attached to and
made a part of this chapter.
[Added by Ord. No. 1993-33; amended 2-12-2018 by Ord. No. 2018-04]
A. Parking prohibited.
(1) Whenever snow has fallen and the accumulation interferes with the
normal flow of traffic on the Township's streets and roads, no vehicle
shall be parked on any of the said Township streets or roads.
(2) The above parking prohibition shall remain in effect during and after
the snow has ceased until the streets and roads have been plowed sufficiently
and to the extent that the parking will not interfere with the normal
flow of traffic on the said streets and roads.
B. Penalties. Unless another penalty is expressly provided by New Jersey
Statute, the following penalties will apply to any person convicted
of a violation of this section:
(1) Any unoccupied vehicle parked or standing in violation of this section
shall be deemed a nuisance and a menace to the safe and proper regulation
of traffic, and any police officer or Road Department supervisor may
provide for the removal and storage which may result from such removal
before regaining possession of the vehicle. The location of vehicles
which may have been towed away may be ascertained by requesting such
information from the Delaware Township Police Department or Road Department.
(2) Unless another penalty is expressly provided by New Jersey Statute,
every person convicted of a violation will be subjected to a violation
of $25 per offense and/or towing at the owner's expense.
[Added 8-13-2001 by Ord. No. 2001-17]
Delaware Township provides parking facilities adjacent to the
Township Hall for employees, volunteers and others either engaged
in Township activities or doing business with the Township. Accordingly,
the public is prohibited from parking vehicles in the facilities on
Mondays through Fridays between the hours of 7:30 a.m. and 9:00 p.m.
The Delaware Township Committee may elect to close the facilities
to the public at other times to meet parking needs for special events.
At other times, members of the public shall be permitted to park vehicles,
except RV vehicles and trailers, at the facilities at their own risk
on a space-available basis.
[Added 12-28-2009 by Ord.
No. 2009-33; amended 1-29-2018 by Ord. No. 2018-01]
