Food establishments and vending machines — See Ch. 369.
The Delaware Township Board of Health hereby creates a subcategory of food establishments known as a "community farmers' market." The requirements of Chapter 369 of the Board of Health Code shall apply. If an individual vendor requires an inspection by the Hunterdon County Department of Health, any such vendor shall obtain a temporary food handler's permit from the Delaware Township Board of Health for a fee, as set forth in the aforesaid Chapter 369.
As used in this chapter, the following terms shall have the meanings indicated:
COMMUNITY FARMERS' MARKET
A food establishment having persons selling produce they have grown, selling produce derivatives they have created; and selling baked goods originating from New Jersey state inspected and licensed facilities, located at a single location operating no more than two days per week in an outdoor location under the management of the Delaware Township Community Farmers' Market Committee.
The Delaware Township Farmers' Market Committee is the recognized organization that is responsible for supervising market operations, issuing annual licenses, and ensuring compliance with orders of the Hunterdon County Department of Health and Delaware Township Board of Health.
The Delaware Township Farmers' Market Committee must designate a Market Manager.
The Market Manager or his/her designate shall be present on site whenever said market is in operation. Market Manager will assure approval of all vendors at the community farmers' market from the Delaware Township Board of Health and the Hunterdon County Department of Health by submitting a preapproval form to the Delaware Township Board of Health and the Hunterdon County Department of Health.
Each vendor is responsible for compliance with all applicable health codes and is subject to penalty for noncompliance.
The Delaware Township Farmers' Market Committee will prohibit any vendor from selling at the community farmers' market if that request is made by the Hunterdon County Department of Health and/or the Delaware Township Board of Health.
A community farmers' market is to have no food prepared on site under the farmers' market license obtained by the Delaware Township Farmers' Market Committee.
The Delaware Township Farmers' Market Committee shall charge each vendor a weekly fee of $10 or a seasonal fee of $100 in order to help defray promotion and operating costs.
