[CC 1983 §70.010]
There is hereby established a Rural Fire Department under the
direction of the Board of Aldermen and Mayor of the City of Hollister,
Missouri, and also the City of Hollister Fire Department; which Rural
Fire Department shall furnish to its members such protection from
fires as such Rural Fire Department is able to provide from the equipment
and manpower available.

The boundary and area of land to be included in the protection
area is to be within a radius of ten (10) road miles from the City
of Hollister, Missouri; and such boundary and area may be altered
and changed from time to time; provided however, that there shall
always be a boundary line established on a map so that the limits
of such Rural Fire Department area are always known to the City Clerk
of Hollister, Missouri, and the Fire Chief of the Hollister Fire Department.

Those people desiring membership within such area for fire protection
of residential and business properties shall pay annually membership
dues as follows: For an initiation membership fee, there shall be
paid the sum of five dollars ($5.00) by both business and residential
property owners; and in addition thereto, there shall be an annual
membership fee of twenty dollars ($20.00) per year for residential
property owners and thirty dollars ($30.00) per year for business
property owners, with membership year to begin on the first (1st)
of November of each year starting with November 1, 1966, and terminating
on the thirty-first (31st) day of October, of the following year.
Such membership may not be transferred with the property in the event
the property is sold from one person to another or no refunding of
membership dues in the event of a sale of such property. Application
of new membership fees will be pro-rated after the first (1st) day
of May to the five dollar ($5.00) initiation fee and to ten dollars
($10.00) for residential and fifteen dollars ($15.00) for business.

Any member of such Rural Fire Department seeking assistance
of fire protection shall make such request to the Chief of the Hollister
Fire Department or other designated persons so named, and such protection
shall only be afforded for residential and business properties and
not for the fighting of grass and brush fires.

The Hollister Rural Fire Department shall have the authority
and permission to enter into cooperative firefighting agreements with
the Forsyth Rural Fire Department and the Branson Rural Fire Department;
providing however, that such agreements must first be approved by
the Hollister Board of Aldermen and Mayor.

The Hollister Rural Fire Department may answer all dispatched
fire calls regardless of whether the call is to the property of a
paid up member or not. For those fire calls answered to a non-paid
up member, there shall be a charge of two hundred dollars ($200.00)
for the first two (2) hours, and one hundred dollars ($100.00) for
each additional hour or any part thereof made by the City of Hollister,
Missouri. All records of memberships shall be kept in the office of
the City Clerk of Hollister, Missouri, and also at the Fire Station
under the control of the Hollister Fire Chief.

Only that firefighting equipment and trucks so designated to
be used outside the City of Hollister, Missouri, shall be used by
such Hollister Rural Fire Department.

All persons becoming members of such Hollister Rural Fire Department
do so with the express understanding that the City of Hollister, Missouri,
shall have no obligation to furnish fire protection to such members,
but that the City of Hollister, Missouri, shall make available to
such Hollister Rural Fire Department such firefighting equipment as
the City has from time to time, with such equipment to be manned and
operated by the members of such Hollister Rural Fire Department under
the direction and control of the Hollister Fire Chief.

All monies received by the City from the initiation fee and
annual membership fee for dues of members of the Hollister Rural Fire
Department shall be used by such Hollister Rural Fire Department for
the repair and replacement of firefighting equipment and for the purchase
of new firefighting equipment as needed.

The City of Hollister, Missouri, hereby contracts with the Cities
of Branson, Forsyth, College of the Ozark, Western and Central Taney
County Fire Protection Districts, effective upon the passage and approval
of a like ordinance by the Board of Aldermen of the Cities or the
Governing Board of the Fire District, for the interchange of service
of the Fire Department of the parties hereto upon the conditions and
provisions hereinafter contained.

The Fire Department of the City of Hollister, Missouri, shall
respond to fire alarms upon request in any part of the Cities of Branson,
Forsyth, College of the Ozarks, and Western and Central Taney County
Fire Protection District, and the Fire Departments of Branson, Forsyth,
College of the Ozarks, and Western and Central Taney County Fire Protection
Districts shall respond upon request in any part of the City of Hollister.

This contract may be terminated at any time during its term
on the passage of an ordinance to that effect by the legislative body
of either party and written notice thereof given to the other party
hereto by serving on the City Clerk of such other municipality a certified
copy of such ordinance terminating this agreement. The termination
shall take effect sixty (60) days from the date of service of such
written notice.

The consideration for the service of the Fire Department of
each municipality shall be the service given for the protection of
lives and property in such municipality by the service of the Fire
Department of the other party hereto, and no compensation shall accrue
or be paid by either party for the service of the Fire Department
of the other party hereto.

Neither party hereto shall be liable to the other party for
failure to respond to any call by such party, or for the delay or
negligence or mistake in receiving or responding to any call, nor
shall this contract be interpreted as being an agreement for the benefit
of any third (3rd) person.

No party hereto shall be liable by reason of this contract to
any fireman, official, or employee of the other, nor shall any fireman,
official, or employee of either entity hereto be considered for any
purpose a fireman, official, or employee of other entity other than
the one (1) by which he/she is regularly employed unless he/she is
employed by more than one (1) entity, in which case he/she shall be
considered an employee of the entity with which he/she shall at the
time in question be serving.

In case of loss or damage to the equipment or property of any
party hereto while responding to fire alarms, such loss or damage
shall be borne by the entity owning such equipment or property.

In effectuating the purpose of this contract, the parties hereto
may maintain direct telephone lines between the fire stations of each
of them to be used exclusively for fire calls. In such event, the
expense of such lines shall be shared equally by the parties hereto.
