A. 
For the purpose of this chapter, the following definitions shall apply:
CRUISING
Driving a motor vehicle past a traffic control point designated by a police officer, in the designated area, at or near the control point, two or more times within any one-hour period.
DESIGNATED AREA
The entire Township of Stowe.
TRAFFIC CONTROL POINT
A reference point on a street in a designated area selected by a police officer for the purpose of enforcing this chapter.
B. 
This chapter can, at the discretion of the Superintendent of Police, Chairman of Public Safety or Township Commissioner, be utilized anywhere within the Township of Stowe limits.
No driver of a motor vehicle or person having care, custody or control of a motor vehicle shall cruise. For the purpose of this chapter, the person having care, custody or control of a motor vehicle shall also be considered a person cruising, regardless whether that person was actually driving the motor vehicle. For the purposes of this chapter, the person having the care, custody or control of a motor vehicle shall be the owner of such vehicle, if present at the time of the violation, or, if the owner is not present, the person or persons having the owner's authority to use the vehicle.
This chapter shall not apply to emergency or police vehicles, licensed taxicabs for hire, other commercial or passenger vehicles driven for business purposes and for residents in the designated area traveling to a specific destination.

A. 
Any person violating any provision of this chapter shall, upon summary conviction thereof, be sentenced, for a first offense within the calendar year, to pay a fine of not more than $300 and not less than $600 and/or be imprisoned in the county jail for a period not exceeding 90 days.
B. 
Upon conviction for a second offense within the calendar year, such person shall be sentenced to pay a fine of not less than $500 and not more than $1,000 and/or be imprisoned in the county jail for a period not exceeding 90 days.
C. 
Upon conviction for a third or subsequent offense within the calendar year, such person shall be sentenced to pay a fine of not less than $1,000 and not more than $3,000 and/or be imprisoned in the county jail for a period not exceeding 90 days.
D. 
Any vehicle found to be without proper registration, insurance, inspection or whose operator is without an owner's card or valid driver's license will have the vehicle impounded. Release of said vehicle will only be made available to the owner with proof of ownership, payment of a fine of $250, along with the costs associated in towing and impounding the vehicle.
