A. 
A vehicle (other than a pedalcycle) shall be presumed to be abandoned in Jersey Shore Borough under any of the following circumstances:
(1) 
The vehicle is physically inoperable and is left unattended on a highway or other public property for more than 48 hours.
(2) 
The vehicle has remained illegally on a highway or other public property for a period of more than 48 hours.
(3) 
The vehicle does not bear all of the following:
(a) 
A valid registration plate.
(b) 
A current certificate of inspection.
(c) 
An ascertainable vehicle identification number.
(4) 
The vehicle has been parked on Borough-owned property continuously for more than 48 hours.
B. 
It is illegal to abandon a vehicle on Borough-owned property in Jersey Shore Borough and is punishable as outlined below.
A. 
Parking on Borough-owned property located at:
(1) 
410 Thompson Street:
(a) 
Lot located at the intersection of Thompson Street and McCanna Drive, across from the Jersey Shore Middle School and south of Bulldog Storage;
(b) 
Lot located at the Thompson Street Recreation Field/Jersey Shore Community Pool Complex;
(2) 
148 South Main Street;
(3) 
155 South Main Street;
(4) 
232 Pennsylvania Avenue; and
(5) 
Located on the southern side of Railroad Street between Underwood Street and Phillips Street used for Rails to Trails access.
B. 
Vehicles parked in the Borough property lots above must be parking properly and entirely within the parking spaces provided.
Any person violating any section of this article is guilty of a summary offense and shall, upon conviction, be sentenced to 90 days in jail and/or a fine of up to $300, or both.
A. 
All ordinances or parts of ordinances inconsistent herewith are hereby repealed to the extent necessary to eliminate inconsistencies.
B. 
The provisions of this article are severable. If any sentence, clause or section of this article is for any reason found to be unconstitutional, illegal or invalid, such unconstitutionality, illegality or invalidity shall not affect or impair any of the remaining parts, sentences, clauses, or sections of the article. It is hereby declared to be the intent of the Borough that such unconstitutional, invalid or illegal sentence, clause or section not be included in this article.
