Pursuant to the authority of N.J.S.A. 40:48-2.13 and 40:48-2.14, the presence upon lands lying within the borough of brush, weeds, dead and dying trees, leaves, stumps, roots, obnoxious growth, filth, garbage, trash and other debris is decreed to be detrimental to public health, safety and the general welfare and likely to present a fire hazard.
The owner or tenant of lands lying within the borough shall be required to remove or cause to be removed from such lands any brush, weeds, dead and dying trees, leaves, stumps, roots, obnoxious growth, filth, garbage, trash and other debris within 10 days after receipt of a written notice to do so from the Construction Official.

Notice to the owner or tenant to cause the removal of the substances referred to in § 53-2 may be served on him either personally or by certified mail at the address to which tax bills are sent; and if by certified mail, the ten- day period within which the removal shall be accomplished shall be deemed to have commenced from the date of the return receipt obtained by the postal authority for the delivery of the notice. Every notice, in addition to requiring removal, shall warn the owner or tenant of the lands to which the notice refers that failure to accomplish the removal within the times stated shall result in the Property Maintenance Officer, or other authorized officer or employee of the Borough, issuing a Complaint in Municipal Court.

A. 
Upon failure to remove any violations in accordance with Chapter 53 within the time provided for in § 53-3, the Property Maintenance Officer, or other authorized officer or employee of the Borough, shall have the authority to issue a Complaint in Municipal Court.
B. 
Maximum penalty. Any person violating any part of this chapter shall, upon conviction thereof, be liable to the penalty provided by Chapter 1, Article III.
