The City Council does hereby authorize the establishment of a farmer's market in the City of Richmond, Missouri, and does hereby authorize licensing procedures for such purpose as hereinafter provided.

In order to create an organized method to allow artisans, farmers and gardeners from the City of Richmond, Missouri, and surrounding Counties to market their products to the public and thereby promote the public good, the City Council may designate a group, organization, or individual to oversee and operate the Farmers' Market. The designated group, organization, or individual shall, with the approval of the City Council, select the exact sites, portions of streets and/or parking lots to be designated as the area for such Farmers' Market and shall designate the dates and hours of operation of the Farmers' Market. In the event the City Council does not so designate a group, organization, or individual, these functions shall be performed by the Community Development Director. The areas, dates and hours of such Farmers' Market so designated shall hereinafter be referred to as the "Farmers' Market."

A. 
No person, firm, corporation or other entity shall sell farm produce, products, or crafted goods at the Farmers' Market without obtaining a license prior to participating in the market. Applications for the Farmers' Market vendor license shall be obtained from the Community Development Department and as detailed in the City's Comprehensive Fee Schedule[1] shall be paid to the City of Richmond unless said fees and license for vendors are waived by the City Council. Such forms shall give the name of the proposed vendor and the address of the farm or garden at which the vendor resides. Such license shall be placed in a prominent place at the site where the produce or crafted goods are sold.

B. 
No person, firm, corporation or other entity shall sell farm products on private property without written permission from the owner of the property he/she sells on.

A. 
The Farmers' Market will open the second Saturday in May and run through the last Saturday in October.
B. 
Spaces will not be reserved at the Farmers' Market but will be on a first-come basis.
C. 
Each licensee shall be responsible for setting up, displaying, and bagging their produce and/or crafted goods in a manner which is sanitary and attractive.
D. 
The licensee's space must be cleaned by broom within one-half (1/2) hour after the end of the selling period.
E. 
No vehicle larger than a pickup truck will be permitted except approved mobile food vending truck as defined in Article VI, Mobile Food Vending.
F. 
Produce and/or crafted goods may not be sold from the trunk of a car.
G. 
Artisans may sell their crafted goods and/or artwork. An "artisan" is defined as a person skilled in an applied art; a craftsperson, a person that makes a high-quality or distinctive product in small quantities, usually by hand or using traditional method.
H. 
No live animals or resale items shall be sold at the Farmers' Market.
I. 
All products must be grown or crafted within a hundred (100) mile radius of the City of Richmond.
J. 
At least eighty percent (80%) of the produce for sale must be grown and/or produced by vendors, or produced by vendors. Items not produced by vendors must be labeled accordingly. No more than twenty percent (20%) shall be bought from others. Vendors selling eggs, meat and/or dairy products must have the required license from the Missouri Department of Agriculture (MDA). Live animals/poultry is not allowed.
K. 
Any foods sold must be from an approved source that is accepted by the Missouri Department of Health and Senior Services.
L. 
Mobile food venders shall comply with all regulations as per Article VI, Mobile Food Vending, of the City of Richmond Code of Ordinances.
M. 
No rummage, second hand or flea market items to be sold.

The enforcement and administration of this Article shall be the responsibility of the City of Richmond.
