Editor's Note: This resolution changed the name of the Authority from the "York Area Transportation Authority" to the "York County Transportation Authority" and provided that there shall be five seats on the Board of the Authority. A resolution enacted 3-29-1995 provided that there shall be 12 members on the Board of the Authority.
A. 
Whereas, by resolution dated the 29th of May 1974, the Board of County Commissioners of York County, Pennsylvania, authorized the establishment and incorporation of the York Area Transportation Authority under the Municipality Authorities Act of 1945, as amended, being the Act of May 2, 1945, P.L. 382, as amended,[1] of the General Assembly of the Commonwealth of Pennsylvania for the purposes contained in said resolution;

B. 
Whereas the Board of County Commissioners of York County, Pennsylvania desires to approve the form of the Articles of Incorporation of said Authority and to authorize the advertisement of the notice of the filing of such Articles of Incorporation with the Secretary of the Commonwealth of Pennsylvania; and
C. 
Whereas the Board of County Commissioners of York County, Pennsylvania, desires to appoint the first members to the Board of the York Area Transportation Authority.
A. 
The Articles of Incorporation of the York Area Transportation Authority to be filed with the Secretary of the Commonwealth of Pennsylvania shall be in the form as attached hereto as Exhibit A and incorporated herein.[1]

B. 
The notice of advertisement of the filing of such Articles of Incorporation of the York Area Transportation Authority shall be in the form as attached hereto as Exhibit B and incorporated herein. Notice of intention of filing the Articles of Incorporation with the Secretary of the Commonwealth of Pennsylvania on November 1, 1974, shall be advertised in the York Legal Record and a newspaper published and of general circulation in York County, Pennsylvania.

D. 
The Articles of Incorporation for the York County Transportation Authority are as follows:
Articles of Incorporation
(a)
The name of the Authority shall be "York County Transportation Authority" and its registered office shall be at 1230 Roosevelt Avenue, York, Pennsylvania.
(b)
The Authority is formed under the Municipality Authorities Act of 1945, as amended, being the Act of May 2, 1945, P.L. 382, of the General Assembly of the Commonwealth of Pennsylvania.[2]
(c)
The authorities created by the Board of County Commissioners of York County, Pennsylvania, are as follows: the York Airport Authority (with City of York), now dissolved; the York County Industrial Development Authority; the Redevelopment Authority of the County of York; the York County Hospital Authority; and the York County Solid Waste and Refuse Authority. No other authority has been organized by the Board of County Commissioners of York County, Pennsylvania, under the Municipality Authorities Act of 1945, as amended, being the Act of May 2, 1945, P.L. 382, of the General Assembly of the Commonwealth of Pennsylvania, as amended, or under the Act approved the 28th of June 1935 (Pamphlet Law 463).
(d)
The name of the incorporating municipality is the "County of York, Pennsylvania."

(f)
The project or projects which shall be undertaken by the Authority are to acquire, hold, construct, improve, maintain, operate, own and lease, either as lessor or as lessee, all facilities necessary or incidental thereto for the operation of a mass transportation system.

(g)
The Authority shall have no power to pledge the credit or taxing power of the County of York, the Commonwealth of Pennsylvania or any political subdivision, nor shall the bonds issued by the Authority be deemed to be obligations of the County of York, the Commonwealth of Pennsylvania or any of its political subdivisions, nor shall the County of York, the Commonwealth of Pennsylvania or any political subdivision thereof be liable for the payment of premium, if any, or interest on the bonds, nor shall the members, officers or employees of the Authority personally be liable on the Authority obligations.
