Any charitable organization as defined in N.J.S.A. 45:17A-20 may request in writing permission from the borough to conduct a charitable solicitation within a public roadway in the Borough of Mount Arlington. Any such request shall set forth the date, times and location of the proposed charitable solicitation. The governing body may, in its sole discretion, grant permission to conduct the charitable solicitation. Any such charitable solicitation shall be conducted in accordance with any rules or regulations adopted by the Department of Transportation and shall be conducted in accordance with all applicable law. No charitable solicitation shall be conducted without prior written notification to the Borough Police Department.
The Borough of Mount Arlington may not authorize any charitable organization to solicit on any county highway or intersection of a county highway without the approval of the Board of Chosen Freeholders. The Borough of Mount Arlington may not authorize any charitable organization to solicit on any state highway or intersection of a state highway without the approval of the Commissioner of Transportation.

Any person who shall violate any of the provisions of this article shall pay, upon conviction, a penalty not to exceed $1,250.
