The borough may accept any bequest, legacy or gift made to it for the specific purpose of assisting in the payment of sewer fees of low-income households in the Borough of Mount Arlington. Said bequests, legacies and gifts, if so specified by the donor, shall be limited solely for the use of the assistance in the payment of sewer fees of low-income households of the Borough of Mount Arlington and shall be separately segregated in the municipal budget pursuant to the provisions of N.J.S.A. 40A:4-39.
The Welfare Director of the Borough of Mount Arlington shall be responsible for the administration of the receipt and processing of applications by low-income households for assistance from the low-income sewer fees account for the payment of all or a portion of their sewer fees established by ordinance of the borough.
The Welfare Director shall prepare a written application form to be utilized to apply for assistance in the payment of sewer fees from the low-income sewer fees account. All applicants shall be required to submit copies of their most recent federal income tax return when making application for assistance from the fund. All applications shall be filed with the Welfare Director on or before January 31 for each year in which the low-income household applies for assistance from the low-income sewer fees account. To ensure continued eligibility, all applicants shall further provide a copy of their federal income tax return for the tax year preceding the calendar year in which application is made to the Welfare Director on or before April 30 of any year in which application is made for assistance from the fund.

The Welfare Director shall determine the qualification of the low-income household to receive assistance from the low-income sewer fees account based upon the same federal guidelines used to determine assistance through the community development program or such similar program as shall be in effect at the time of application to the Welfare Director. The Welfare Director shall prioritize all applicants based upon need and shall make a recommendation for a pro rata distribution of assistance from the fund to all low-income households equally prioritized based upon the amount of funds in the account at the time that the Welfare Director determines eligibility and priority of all applications to the fund.

The Welfare Director shall make a recommendation to the Mayor and Council to provide assistance from the fund. The Mayor and Council shall by resolution adopt in whole or in part the recommendation from the Welfare Director to authorize the issuance of assistance from the fund.
Any sum to be expended from the low-income sewer fees account on behalf of any low-income household of the Borough of Mount Arlington shall be made in the form of a credit against any sewer fee bill issued by the borough to the low-income household.
Any person aggrieved by any decision of the Welfare Director may appeal the Welfare Director's decision to the Mayor and Council, whose decision on the expenditure or nonexpenditure of any fund from the Mount Arlington low-income sewer fees account shall be final.
