As used in this chapter, the following terms shall have the following meanings, unless the context clearly requires a different meaning:
CODE OR NATIONAL ELECTRICAL CODE
The National Electrical Code more fully described in § 165-2.
ELECTRICAL CONSTRUCTION AND ELECTRICAL INSTALLATION
Any electric wiring, appurtenances, installation, structures, conduits and equipment in, on or about any premises, public or private, or any building or structure, including any exterior sign or display.
ELECTRICAL INSPECTION AUTHORITY
A person, firm, corporation or other entity which engages in the business of inspection of electrical construction and which is certified by the New Jersey Board of Public Utility Commissioners. No person, firm, corporation or other entity shall engage in the business of inspection of electrical construction unless certified by the New Jersey Board of Public Utility Commissioners.
PERFORM ANY ELECTRICAL CONSTRUCTION OR INSTALLATION WORK
The construction, installation or extension of any electrical construction.
PERSON
Includes any person, firm, corporation or other entity of any kind.

There is hereby adopted by reference the whole of that certain code known as the "1975 National Electrical Code," adopted by the National Fire Protection Association and by the American Standards Association, also identified as "NFPA No. 70-1975:" together with all supplements and additions thereto as are in effect as of the date of introduction of this chapter, of which three copies have been and now are filed in the office of the Borough Clerk and in the office of the Chief of the Fire Prevention Bureau and shall remain on file in said offices for the use and examination of the public so long as this chapter shall remain in effect. Said National Electrical Code is hereby incorporated by reference and made part hereof as fully as though it had been set forth at length.
No person shall perform or cause or permit to be performed any electrical construction or installation work unless the same shall conform in all respects to the applicable provisions of the code and unless the same shall be safe to use in the service for which the equipment is intended without unnecessary hazards to persons or property. Conformity of electrical equipment with applicable standards of Underwriters' Laboratories, Inc., and conformity of electrical installations with applicable regulations set forth in the National Electrical Code shall be prima facie evidence of compliance with this chapter.
A. 
No person shall perform any electrical construction or installation work without first applying to an electrical inspection authority for inspection thereof.
B. 
If emergency work is necessary in order to maintain service on an electrical system, the necessary work may be performed forthwith, provided that the application for inspection shall be made on the next following working day.
C. 
An electrical inspection authority to whom an application for inspection is submitted shall, in addition to any and all other requirements prescribed by the New Jersey Board of Public Utility Commissioners, as soon as possible following the receipt of such application, advise the Fire Prevention Bureau thereof and, as soon as possible following the making of such inspection, shall file a report thereof with the Fire Prevention Bureau.
D. 
No electrical construction or installation shall be connected to an electrical power source and put into use, nor shall any electrical construction or installation be sealed, covered or concealed in such manner as to be unavailable for inspection, until such construction or installation shall have been inspected and approved by an electrical inspection authority.
A. 
If he has reason to believe that any electrical construction or installation may be unsafe or in violation of any provisions of this chapter, the Chief of the Fire Prevention Bureau may request that an inspection thereof be made by an electrical inspection authority for the purpose of determining whether such installation is safe and does conform to all provisions of this chapter.
B. 
The report of such inspection shall be submitted to the Fire Prevention Bureau as soon as possible following completion thereof. If the inspection discloses that such installation is unsafe or in violation of this chapter, then the Fire Prevention Bureau shall take such action as may be necessary to cause the same to be corrected, as set forth in § 165-6.
C. 
Subject to law and for the purpose of making any inspection, test or report necessary for the proper administration and enforcement of this chapter or to determine compliance with this chapter, any member of the Fire Prevention Bureau, or any electrical inspection authority requested to do so by the Fire Prevention Bureau shall have the authority, during reasonable hours, to enter into and upon any building or premises, and no person shall prevent, obstruct or interfere with the performance of any inspection or test made pursuant hereto.
A. 
If an electrical construction or installation which is connected to a supply of electricity is found to be in violation of the requirements of this chapter, the Chief of the Fire Prevention Bureau shall notify the person owning or using the construction or installation and direct him to correct the same within 10 days, provided that the Chief of the Fire Prevention Bureau may, if necessary, grant additional time to correct the same beyond said ten-day period. If, after said ten-day period has elapsed or such further reasonable time as may be granted upon request, the violation has not been corrected and so certified by a report of an electrical inspection authority, the Chief of the Fire Prevention Bureau shall have the authority to disconnect or order the disconnection of electrical service to said electrical construction or installation.
B. 
In cases of emergency, when necessary for safety to persons or property or when electrical equipment may interfere with the work of the Fire Department, the Chief of the Fire Prevention Bureau shall have the authority to disconnect or order the disconnection of electrical service to electrical construction or installations.
The provisions of this chapter shall not apply to work done in connection with lines or equipment owned by a public utility as defined in N.J.S.A. 48:2-13, and directly used in the supplying of its services.
A. 
Any person who violates any provision of this chapter, including the National Electrical Code of the borough incorporated herein by reference, or who violates or fails to comply with any order made pursuant to this chapter, including the National Electrical Code, shall, upon conviction thereof, be punished for violation by a fine not exceeding $1,000 or by imprisonment for a term not exceeding 90 days, or both. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.[1]

B. 
The imposition of a penalty for a violation or a noncompliance with any provision or order described in Subsection A of this section shall not excuse said violation or noncompliance or permit it to continue or be held to prevent the enforced removal of the prohibited condition, and such violation shall be remedied within a reasonable time.
