As used in this chapter, the following terms shall have the meanings indicated:
COMMERCIAL ESTABLISHMENT
Any building, store, structure, premises or property upon or in which is conducted or which is used in connection with any business, trade, manufacture, enterprise or industry, either wholesale or retail, and whether or not the same shall be for profit or otherwise.
GARBAGE, RUBBISH, WASTE, ASHES AND REFUSE
Includes animal or vegetable matter, paper, paper products, paper or wooden boxes or containers, glass, furniture, clothing, metal, rubber, grass, leaves and branches, lumber or building materials, crockery, cardboard and waste resulting from the operation of a business, trade or industry. This definition shall not exclude other materials from coming within the definition of the stated words and shall not be a limitation.
OCCUPIER
Any person, firm or corporation who shall be in actual or constructive possession of said premises.
OPERATOR
The person, firm or corporation who shall be operating or conducting the business, trade, manufacture, enterprise or industry on said premises.
OWNER
The person, firm or corporation to whom the premises are assessed according to the assessment rolls of the borough.
SUFFICIENT
At least two metal cans, metal barrels or metal receptacles for each commercial establishment and such additional number of cans, barrels or receptacles as may be needed in each particular instance.
SUITABLE
A receptacle, can or barrel made of metal of substantial nature, such as galvanized iron with tight-fitting cover of metal, so constructed as to prevent spilling or leaking of its contents. It shall be waterproofed and equipped with a pull handle or handles. A suitable enclosure shall be one so constructed as to have the required capacity and which will prevent the contents therein contained from escaping, spreading or being littered about by either the action of animals or the weather.
It shall be the duty of the owner, occupier or operator of every residence and commercial establishment within the limits of the Borough of Maywood to keep on such premises sufficient and suitable receptacles or cans or barrels and covers for the same for receiving and holding refuse, materials, waste, rubbish, garbage and ashes.
All receptacles, cans or barrels which shall be used to receive or hold any material that gives off a strong or annoying or noxious odor or which shall attract or draw insects or rodents shall be provided with tight-fitting covers.
It shall be the duty of the owner, operator or occupier of every commercial establishment within the limits of the Borough of Maywood to provide in the rear yard area an enclosure suitable to receive and hold all boxes, paper boxes, boxes in any form or other rubbish which cannot be stored or contained in garbage cans or other receptacles. Such enclosure shall not be unsightly and shall be large enough to accommodate garbage cans, barrels or other receptacles and the aforesaid materials and rubbish which cannot be stored in garbage cans or other receptacles.
It shall be the duty of the owner, operator or occupier of commercial establishments in the Borough of Maywood to maintain said enclosure and said cans, receptacles or barrels in good condition to prevent the spread of filth, garbage, rubbish, ashes and other refuse materials in and about the property of said establishment, the public streets, ways and walks or any adjoining property and to prevent the spread of annoying or noxious odors and to prevent the harboring, drawing or attracting of insects, rodents or other animals.
The use of baskets as receptacles under this chapter is prohibited.
It shall be the duty of the owner, operator or occupier of all premises to maintain said cans, barrels, receptacles, containers and enclosures in good and suitable condition, and all containers should be kept at a distance of not less than five feet from the adjoining property line, so as not to become a nuisance. Cans, barrels, receptacles or containers which are broken, rusted, perforated or otherwise fail to meet the requirements of this chapter shall be replaced. Enclosures shall be kept in good condition to meet the requirements of this chapter.
