The following words, when used in this article, shall have the meanings ascribed to them as set forth in this section, unless the context shall clearly indicate or require a different meaning:
LANDLORD
Any person who owns and leases all or any part of his real estate to another person for a dwelling unit for a consideration, monetary or otherwise, or who owns and permits another person to use or occupy all or a part of his real estate for a dwelling unit with or without consideration.
OCCUPANT
Any person who uses or occupies real estate other than the owner/landlord thereof.
PERSON
Any natural person, partnership, association, firm, company, corporation or other entity.
TENANT
Any person who leases real estate for a consideration, monetary or otherwise.
Within 30 days of the effective date of this article, or within 30 days of a new tenant occupying a rental unit, all landlords shall distribute to each tenant occupying a dwelling unit owned by such landlord a report form furnished by the Secretary of the Borough of Hanover for purposes of reporting such information as is required thereon. The landlord shall certify to the Borough of Hanover that such report form has been distributed to such tenant and further state that a tenant is occupying a certain dwelling unit or numbers of dwelling units by specifying the address of the same, unit number, apartment number or some other meaningful method which will allow the Borough of Hanover to identify such dwelling unit as it is occupied by the tenant.
Within 30 days of the receipt of such report form from the landlord, each tenant shall complete such information as the form may require, including but not limited to the names or names and sex of the tenants and occupants of said units; if natural persons, the age of each occupant and tenant and recertification as to which unit is leased or occupied by each.
The Borough Secretary is hereby authorized to prepare and distribute such form or forms as shall be necessary for recording and filling information required by this article, together with such other information as the Borough Secretary shall deem reasonably necessary and relevant to enable the Borough to determine the taxability of any person under any Borough taxing ordinances now or hereafter in effect.
Any landlord or tenant who shall violate any of the provisions of this article shall, upon conviction thereof in a summary proceeding before a Magisterial District Judge, be sentenced to pay a fine not in excess of $300, and costs of prosecution, and, in default of such payment, to undergo imprisonment in the York County Jail for a period not exceeding 30 days.
