There is a department of parks and recreation (beaches) which shall have the powers and perform the duties as set forth in this chapter.

The head of the department of parks and recreation (beaches) shall be appointed by Borough council, and whether such appointed person is referred to as "department head," "superintendent," "chairperson," "director" or other designation, such appointed person shall in any event be subject to and have the powers and duties of department heads, as set forth in Section 2.40.020 and except as otherwise specified in this code. Such appointment shall be for one year or less, as specified by resolution of Borough council.

The appointed department head of the department of parks and recreation (beaches) shall be under the jurisdiction and auspices of a committee consisting of three members of Borough council appointed by the mayor. No action shall be taken by the department head without the consent and approval of such committee, and such committee may direct the department head to perform such other duties pertaining to parks and recreation (beaches) as it may from time to time deem fit and consistent with law.

Within the department of parks and recreation (beaches) there shall be a division of beach operations. A supervisor of beach operations shall be appointed by the Borough council, based upon the recommendation of the parks and recreation committee and shall perform all duties in accordance with established policy and procedures of the governing body. The supervisor shall report directly to the Borough administrator. The Borough council shall appoint a supervisor of the beach badge checkers, based upon the recommendation of the parks and recreation committee who shall perform all duties in accordance with established policy and procedures of the governing body. The beach badge supervisor shall report directly to the beach operations supervisor. Under the direction and supervision of the supervisor of beach operations, the division shall:
A. 
Regulate and control the beach patrol and members thereof, including without limitation lifeguards, beach badge checkers, and Borough personnel assigned to beach regulation and maintenance;
B. 
Regulate and control all aspects of beach operations. Where such duties constitute action which involves other departments of the Borough in operation or regulation of personnel, this department shall confer with such other departments, but this department shall have superseding authority pertaining to beaches;
C. 
Supervise, regulate and control all aspects of beach patrol, operation, and badges, including without limitation, beach badge personnel, beach badge sales and the like;
D. 
Supervise, regulate and control all aspects of beach patrol, operation, and badges that may directly or indirectly involve or have an impact upon public funds. No department head appointed hereunder or any subordinate officer or employee in this department shall be in any way involved with moneys, purchases, sales or other activities involving funds, whether or not deemed public, without the written consent and approval of the overseeing committee;
E. 
The department head shall be responsible for insuring that any beach personnel and have such training as my be required by law, and shall provide such documentation to that effect as the overseeing committee may from time to time request;
F. 
Supervise, regulate and control the use of equipment assigned to the beach, or involving department operations;
G. 
Supervise, regulate and control such additional training as and competitive exercises as may from time to time be deemed necessary or desirable. No such training or competition nor use of the Borough name, funds or equipment shall be utilized without the written consent of the overseeing committee;
H. 
Supervise and regulate the tennis courts;
I. 
Supervise, coordinate and regulate special events on the beach.

Within the department of public works there shall be a division of boat ramp operations. Under the direction and supervision of the Borough supervisor of the boat ramp, the division shall regulate and control all aspects pertaining to boat ramps within the Borough, including, without limitation, boat ramp personnel, maintenance and use thereof.

Within the department of public works there shall be a division of community recreation operations. Under the direction and supervision of the Borough clerk, the division shall:
A. 
Perform all duties in accordance with established policy and procedures of the governing body;
B. 
Regulate and control all aspects pertaining to community or public events held on Borough property including the regulation and control of ball fields.
