A. 
License Required. No person shall conduct a carnival, circus, rodeo, wild animal show or other show or exhibition of a similar nature without having first obtained a license therefor from the Borough clerk.
B. 
Application for License. Applicants for a license under this section must file with the Borough clerk a sworn statement in writing which shall give the following information:
1. 
The name, permanent address and local address of the applicant;
2. 
A description of the nature of the show which the applicant desires to conducts;
3. 
The date or dates and the times at which such show will be conducted;
4. 
The names and permanent and local addresses of all employees and agents of the applicant who shall participate in the conduct of such show;
5. 
A statement as to whether or not the applicant or any of his or her employees or agents has ever been convicted of any felony, high misdemeanor, misdemeanor, disorderly persons offense or the violation of any municipal ordinance other than traffic violations, the nature of the offense and the punishment or penalty assessed therefor;
6. 
Appropriate evidence as to the good character and business responsibility of the applicant which will enable an investigator to properly evaluate such character and business responsibility;
7. 
At the time of filing the application, a fee of $10 shall be paid to the Borough clerk to cover the cost of investigation of the facts stated therein.
C. 
Investigation of Applicants.
1. 
Each application shall be referred to the chief of police or officer in charge of the police department who shall immediately institute such investigation of the business and moral character of the applicant, his or her employees and concessionaires as he or she deems necessary for the protection of the public good and shall endorse the application in the manner prescribed in this section within a reasonable period of time after it has been filed by the applicant.
2. 
If, as a result of such investigation, the applicant's character or business responsibility is found to be unsatisfactory or the products or services are not free from fraud, the chief of police shall endorse on such application his or her disapproval and his or her reasons for the same and return the application to the Borough clerk who shall notify the applicant that his or her application is disapproved and that no license will be issued.
D. 
Validity. Every license issued under this section shall remain in force and be valid only for the time therein expressed, shall apply only to the person to whom granted, and shall not be transferable.
E. 
License Display. Any licensee under this section is required to exhibit his or her license upon request.
F. 
Exemption of Charitable Functions. Where such show or exhibition is conducted by any local nonprofit-making organization and where, in addition, all funds received through conducting such affair are wholly devoted to the nonprofit objectives of such organization or for local charitable or civic purposes, no license fee shall be charged and the requirement of a bond may be waived by the Borough attorney if, in his or her opinion, the public good will not be impaired by such a waiver.
