No person, partnership or corporation shall sell or deliver or have in possession for sale or delivery in the Town of West New York any milk without first obtaining a license from this Board for such sale or delivery.
Any person or firm or corporation obtaining a permit from this Board shall furnish the Chief Inspector a true statement in writing upon blanks to be supplied by this Board, setting forth the locality from which said milk was procured and the name(s) of the person, persons or corporation from whom said milk was purchased, and the names and addresses of all customers they may sell or deliver milk to in this Town, and said blanks shall be signed by the person selling said milk and a copy of said permit shall be filed in the office of the Board.
No person, persons or corporations shall hereafter engage in the sale or exposure for sale of milk within the Town of West New York without first having filed a true and complete statement of the locality from which all the milk that they handle is produced, a complete list of the person or persons from whom the said milk is purchased and the locality from which the milk is obtained. Notification shall be made in writing to this Board immediately upon changing the source of supply of milk.
No person, partnership or corporation shall have, at any time or place, milk, cream, butter or cheese which is kept for sale or delivery in the Town, and is unwholesome, watered or adulterated; or which contains unhealthful ingredients or is stored in an unclean manner; or which is procured from cows that are stabled or kept under unhealthful conditions; or from cows that have been fed, in whole or in part, on swill slops or brewery grains; or from diseased or sick cows.
Skimmed milk shall be known as and labeled "skimmed milk," and no buttermilk shall be offered for sale that has not been produced by the natural process of churning.

All milk sold or delivered in the Town of West New York shall be sold or delivered in bottles, but no milk in partially filled bottles shall be sold or offered for sale in said Town. No bottle shall be filled, capped or recapped outside the building regularly used for this purpose, and the room or rooms therein used for the purpose of bottling milk shall at all times be kept in a clean and sanitary condition. Milk bottles shall be used for no other purpose than as receptacles for milk; provided, however, that milk sold in wholesale quantities for direct use within said Town shall not be required to be delivered in bottles if the Board of Commissioners in its judgment finds that the said milk, upon analysis, meets the requirements of this chapter.
Bottles or other milk containers shall not be left with any family in which there is any contagious disease.
All bottles used for holding milk or cream must be cleaned and rinsed with boiling water as soon as emptied before they are returned to the dairyman.
No person having a communicable disease, or one caring for a person having such disease, shall be allowed to handle the milk or milk utensils. This rule also applies to persons that engage in businesses that bottle beverages.
Bottles shall not be equipped with stationary stoppers or wire attachments on returnable bottles; patent caps should be applied.
Every person having a permit to sell or distribute milk in West New York shall keep the permit posted in a conspicuous place on his premises from where the milk is sold or delivered.
A. 
No license as required in § 322-36 shall be issued by this Board until there shall have been paid to this Board the sum of $2 for a proper inspection and supervision of the sale of milk as required in §§ 322-37, 322-38, 322-39, 322-40 and 322-41.
B. 
The amount established by Chapter 186, Fees, Article II, Health Department Fees, shall be charged to each person, firm or corporation so licensed for each vehicle used for the sale or delivery of milk in the Town of West New York, New Jersey, which sum shall be paid in advance of the license being granted.

C. 
The amount established by Chapter 186, Fees, Article II, Health Department Fees, shall be charged to any person, firm or corporation which shall be the owner, operator or lessee of any milk depot located in the Town of West New York, which sum shall be paid in advance of the license being granted.

D. 
For the purposes established and expressed in this article, a milk depot is defined as follows: A milk depot is any place, premises or establishment where milk or milk products are collected, handled, stored or prepared for distribution to vehicles for retail stores and/or home delivery. A depot shall also include immobile trailers (vehicles incapable of mobility on their own).

E. 
This Board shall furnish with each license two signs for each vehicle, for the sum of $0.50, which shall be conspicuously displayed, to the satisfaction of this Board, one sign, on each side of every such vehicle or conveyance, and said signs must be kept thereon until the expiration or revocation of said license.
