Editor's Note: Ordinance No. 1745, adopted 11-26-86, as amended 1-18-89 by Ord. No. 1835, provided that the provisions of Ord. No. 884 shall not apply to fruit and vegetable stores, which shall be permitted to display fruits, vegetables, flowers and plants on the sidewalk area adjacent to the storefront; however, said sidewalk area occupied by the display of fruit, vegetables, flowers and plants shall extend not more than 28 inches from the facade of the storefront and shall be positioned in such a way that pedestrian traffic is not encumbered. Said ordinance provided that any store operator or property owner who wishes to use the sidewalk area in this fashion shall file a certificate of insurance with the Town Clerk's office, which sets forth a liability policy on the part of the store operator in an amount not less than $100,000/$300,000. Said ordinance also provided that nothing herein shall place any responsibility on the Town of West New York for the suspension, control and/or maintenance of said sidewalk areas which are occupied by fruit, vegetable, flower and/or plant displays. Finally, said ordinance provided for the repeal of Ord. No. 1624, adopted 3-21-84, which had set forth similar provisions.
It shall be unlawful for any person or persons, partnership or corporation to erect or maintain stands or showcases, or display or sell merchandise on or from the sidewalks of this town, or to place any article, substance or thing upon the sidewalks of said town in any manner so as to encumber the same.
It shall be unlawful for any person or persons, partnership or corporation to offer or display for sale or to sell any goods, wares or merchandise from any store premises fronting on any street or avenue in said town in such a manner as to encumber the sidewalk in front of said store premises.

Anything in the within article to the contrary notwithstanding, the Board of Commissioners may, on no more than four occasions in any one year, authorize by resolution the holding of a special sidewalk sale. Such authorization to hold a special sidewalk sale shall be available to all merchants having a retail store within the Town of West New York. Each of the four occasions shall extend for no more than four days. Additionally, merchants having a retail store within the Town of West New York are permitted to hold sidewalk sales on all Saturdays, including holidays, during the period commencing the week before the Thanksgiving holiday and ending the week after Three Kings Day (January 6).

Any person, firm or corporation violating any of the provisions of this article shall, upon conviction thereof, be subject to the penalties provided for in Chapter 1, General Provisions, Article I, and each and every day in which said violation exists shall constitute a separate violation.
