[HISTORY: Adopted by the City Council of the City of Camden as Ch. 285 of the 1987 Code. Amendments noted where applicable.]
A. 
As used in this chapter, the following terms shall have the meanings indicated:
PUBLIC HEALTH NUISANCE CODE OF NEW JERSEY (1953)
That certain code approved by the State Department of Health on September 16, 1953, for adoption by reference in accordance with law, being a code:
(1) 
Defining and prohibiting certain matters, things, conditions or acts as a nuisance.
(2) 
Prohibiting certain noises or sounds.
(3) 
Requiring proper heating of apartments.
(4) 
Prohibiting lease or rental of certain buildings.
(5) 
Prohibiting spitting in or upon public buildings, conveyances or sidewalks.
(6) 
Authorizing the inspection of premises by an enforcing official.
(7) 
Providing for the removal or abatement of certain nuisances and the recovery of expenses incurred by the City in removing or abating such nuisances.
B. 
Whenever the following words, terms or phrases are used in the Public Health Nuisance Code of New Jersey (1953), they shall have the following meanings herein given:
BOARD OF HEALTH
The Department of Human Services of the City.

MUNICIPALITY
The City of Camden.
A. 
Pursuant to and in accordance with the Public Health and Sanitation Codes Adoption by Reference Act (N.J.S.A. 26:3-69.1 to 26:3-69.6), there is hereby established and adopted as the Public Health Nuisance Code of the City the whole of the Public Health Nuisance Code of New Jersey (1953), save and except Section III thereof entitled "Proper Heating of Apartments," which section is deleted therefrom and not adopted herein. A printed copy of said code, plainly marked so as to indicate the deletion of Section III thereof, was annexed to and incorporated by reference in Ordinance No. MC-92, passed October 25, 1962, adopting said code.
B. 
The Public Health Nuisance Code of New Jersey ( 953), which includes Section IV, Prohibition of Certain Noises or Sounds, as defined therein and below, is hereby incorporated in this chapter by reference and made a part hereof as fully as though it had been set forth at length herein except Section III thereof specifically deleted therefrom and not adopted.

C. 
Section IV of the Public Health Nuisance Code of New Jersey (1953), as noted above, which has been hereby incorporated in this chapter by reference and made a part hereof, specifically prohibits certain noises and sounds. It shall be unlawful for any person to make, cause or suffer or permit to be made or caused upon any premises owned, occupied or controlled by him or it, or upon any public street, alley or thoroughfare in this municipality, any unnecessary noises or sounds by means of the human voice, or by any other means or methods which are physically annoying to persons, or which are so harsh, or so prolonged or unnatural, or unusual in their use, time and place as to occasion physical discomfort, or which are injurious to the lives, health, peace and comfort of the inhabitants of this municipality or any number thereof.

D. 
It shall also be unlawful for any person to make, cause or suffer or permit to be made or caused in or upon any public park within the City of Camden any unnecessary noises or sounds by means of the human voice, or by any other means or methods, including but not limited to radios, telephones or any other form of electronic device, which are physically annoying to persons, or which are so harsh, or so prolonged or unnatural, or unusual in their use, time and place as to occasion physical discomfort, or which are injurious to the lives, health, peace and comfort of the inhabitants of this municipality or any number thereof.

E. 
In accordance with law, the required number of printed copies of the Public Health Nuisance Code of New Jersey (1953), plainly marked so as to indicate the deletion of Section III not adopted as aforesaid, have been placed on file in the office of the City Clerk and in the office of the Department of Human Services and shall remain on file in said offices for the use and examination of the public so long as this chapter shall remain in effect.

F. 
The City of Camden adopts the New Jersey State Housing Code. N.J.A.C. 5:28-1 et seq., which shall be the minimum standard used to determine the fitness for buildings for human habitation, use or occupancy in the City of Camden. These standards may be enforced by the County Health Officer, Camden City Health Officer, or any other designee allowed by law. If any provision of the New Jersey State Housing Code conflicts with any provision in this chapter or any other chapter of the Camden Municipal Code, then the more restrictive provision shall apply to the extent allowed by law.

The Public Health Nuisance Code of the City of Camden, adopted by reference the New Jersey Public Health Nuisance Code as said City code under § 523-2A of the Code of the City of Camden, is hereby amended to read as follows:
2.1(j)
Pursuant to N.J.S.A. 24:14A-1 et seq., adopted by reference, the presence of lead paint upon the interior of any dwelling causing a hazard to the occupants of such dwelling as provided under the aforesaid statute.

Unless otherwise provided in the chapter, penalties against persons violating the provisions of this chapter shall be imposed in accordance with the provisions of § 1-15.
