No person shall do any of the following things at or upon the beaches or areas of public waterfront access within the City of Perth Amboy:
A. 
Dispose of, deposit or throw garbage, refuse or any other materials upon the beach or in the water along the beach.
B. 
In any way damage, destroy or disfigure any beach or any area of public waterfront access.
C. 
Use loud music, voice amplification equipment or emit noise in any fashion which annoys or disturbs beach patrons.
D. 
Do anything to endanger the life, safety, and welfare of himself, herself or others.
E. 
Interfere with or obstruct any police officer in the performance of his duties.
F. 
Consume an alcoholic beverage on the beach.
G. 
Change clothes, dress, undress or otherwise disrobe, except outer wraps.
H. 
Engage in the peddling of any type of products, not limited to: food, food products, beverages, ice cream or similar products, or confections on any beach or public waterfront, except that peddling may be allowed in certain designated areas subject to procurement of the appropriate License as required by Chapter 317 of this Code.
I. 
Operate a motor vehicle of any kind on the beaches (except for authorized municipal, county, state and federal vehicles).
J. 
Launch or land personal watercraft (jet skis) or other such motorized boats or crafts on the beaches of the City of Perth Amboy (except for authorized municipal, county, state and federal vehicles).
K. 
No ball playing on the beach or waterfront area, except in certain designated areas.
L. 
No animals of any kind, other than certified service animals, shall be allowed on the beaches.
M. 
No open flames of any kind permitted on the beach.
N. 
No person shall use or tamper with any boat or lifeguard equipment without the permission of the Beach Manager, the Captain of the lifeguards or the City Administrator.
O. 
The placing of any private storage boxes or alike on the beach on, or under the fishing pier is prohibited.
P. 
Only non-alcoholic beverages in non-disposable containers are permitted on the beach. Possession and consumption of alcoholic beverages is prohibited at all times.
Q. 
Playing ball, Frisbee, flying kites, or any other game that may endanger patrons on the beach or in the water, is limited to designated times and area as posted or as determined by Beach Manager.
R. 
Digging holes, or removing any soil, rock, sand, stones, or materials, or making any excavation by tool, equipment, blasting or other means or agency, or erecting tents, canopies and fencing is prohibited. Beach umbrellas are permitted.
S. 
Soliciting, begging or panhandling of any kind is prohibited.
T. 
No improper use of foot or body rinse stations.
The beaches or areas of public waterfront access are open to the public from sunrise to sunset but this shall not prevent fishing or crabbing or other similar activities as permitted and regulated in Chapter 229.
The Police Department of the City of Perth Amboy is hereby directed to enforce this chapter and have proper signage calling attention to the provisions of this chapter erected or placed along the designated areas.

No person shall bathe or swim from the beachfront except from the protected bathing beaches, as designated by flags or signs and where lifeguards are provided by the City of Perth Amboy, and only at such times as the lifeguards are on duty. Lifeguards shall be maintained on duty at the protected bathing beaches during bathing hours as established above in § 153-2. Beach hours, except at such times when bathing or swimming shall be deemed dangerous or hazardous by the Beach Manager, the lifeguard in charge of the beach or the Captain of the lifeguards. When such dangerous conditions exist, a sign or red flag shall be displayed indicating that the beach is closed to bathing or swimming and no person shall bathe or swim in said waters adjacent to the beach, whether protected or not, at any time until the signs or flags are removed. No person shall bathe or swim in said waters adjacent to the beach at night or during the hours of darkness. Lifeguards shall have charge, control and supervision of the bathing, swimming and surfing at the respective designated beaches and, generally on all the beaches and beachfront of the City and in the waters adjoining the same. Nothing herein shall be construed to limit the authority of the Perth Amboy Police Department or any other law enforcement agency to enforce the laws of the state or ordinances of the City on all the beaches and beachfront of the City and in the waters adjoining the same. Failure to obey, or disregard of the oral or visual command, whistle or signal, or the directive of a lifeguard or law enforcement officer not to enter the beaches, beachfront or water adjoining the same, not to surf in the waters, not to swim or bathe beyond the designated swimming or bathing areas or in waters deemed hazardous or dangerous by the lifeguard, not to leave the waters or the beach or beachfront with or without paraphernalia or equipment, whether swimming, bathing, surfing or being thereon, as the case may be, shall constitute a violation of this section. The City shall provide beach patrols consisting of regular and/of special law enforcement officers.

Any violation of this chapter shall be punishable by a fine not to exceed two thousand dollars ($2,000) per each offense.
