City of Perth Amboy, NJ Article II Spray Paint

§ 250-5 Nuisance declared.

The Council of the City of Perth Amboy hereby declares that graffiti displayed upon public and private property is a public nuisance and that spray paint containers are sometimes used for this purpose.

§ 250-6 Possession by minors prohibited.

Any person under the age of eighteen (18) years shall not possess upon his person spray paint dispensing containers.

§ 250-7 Sale to minors prohibited.

It shall be unlawful for any merchant to sell spray paint dispensing containers to any person under the age of eighteen (18) years.

§ 250-8 Violations and penalties; remediation.

A. Any person who sells, gives or otherwise transfers to any other person under the age of eighteen (18) years shall be in violation of this Article and, upon conviction, be punished by a fine not less than five hundred dollars ($500) and not exceeding one thousand dollars ($1,000).

B. Additionally, such person adjudged to be in violation of this Article shall, in addition to the fine, pay the full cost of remediating any graffiti produced by the person under eighteen (18) years old, whether or not said violator had actual custody, control or knowledge of the graffiti acts.
