The code enforcement official shall be appointed by the mayor with the advice and consent of council to serve for a term of one year. Prior to his or her appointment, he or she shall provide a copy of his or her resume setting forth his or her qualifications and experience to perform the duties of code enforcement official to the Borough clerk.

The code enforcement official shall:
A. 
Enforce all ordinances, codes and emergency resolutions of the Borough and perform all other duties prescribed by the mayor and council;
B. 
Specifically but not limited to:
1. 
Recycling.
2. 
Dogs and cats.
3. 
Nuisances.
4. 
Trailers, automobiles, campers — illegally stored/used.
5. 
Building permits.
6. 
Unfit dwellings — animal houses, safety.
7. 
Garbage, trash, rubbish containers — illegal dumping.
8. 
Unfit properties — Weeds, etc.
9. 
Illegal boat launching.
10. 
Streets and sidewalks.
11. 
Parks and recreation areas.
12. 
Board of health regulations, and other such ordinances, codes and emergency resolutions of the Borough as directed by the mayor and council.
C. 
Keep a record of all proceedings in his or her office and a book of all complaints made to him or her as code and ordinance enforcement official, which shall be open for inspection by the mayor and council and shall remain the property of the Borough;
D. 
Enforce all the laws of the state of New Jersey;
E. 
Report each month to the mayor and council in writing on all violations issued by him or her;
F. 
Make recommendations to the mayor and council for the improvement in the enforcement of the Borough ordinances, codes and emergency resolutions.

Junior code enforcement officials shall be appointed from time to time as the mayor and council deem necessary. Such appointment shall be in the same method and manner as in Section 2.32.010.

The code enforcement official and the junior code enforcement official shall be law enforcement officers and shall specifically be empowered to issue summonses returnable in the municipal court of the Borough on the forms prescribed by the administrative director of the courts pursuant to R.1:32.3 of the rules governing the courts of the state of New Jersey. The reference in this section to the rules governing the courts of the state of New Jersey shall also apply to any changes or successor rules adopted by the Superior Court of the state of New Jersey.

Code enforcement officials may issue warning notices of violations at his or her discretion and as they deem necessary to effectuate the violations correction prior to the actual issuance of a summons.

A. 
The code enforcement official and the junior code enforcement officials shall not have the power to arrest violators. If arrest is justified, in their opinion, they shall make a formal complaint before the clerk of the municipal court, who shall then issue process in accordance with the New Jersey Rules of Court.
B. 
The code enforcement official and the junior code enforcement officials shall not carry firearms, night sticks, handcuffs, or other implements designed for crowd control or as an aid or assistance to making an arrest.
