[HISTORY: Adopted by the Board of Health of the Township of Union (now Barnegat) 6-17-71. Amendments noted where applicable.]
A code regulating premises on which swine are maintained; establishing minimum standards governing the location and maintenance of such premises; authorizing inspections of such premises; declaring and defining certain acts or conditions on such premises as nuisances; declaring and fixing penalties for violations thereof, is hereby adopted pursuant to Chapter 188, P.L. 1950 (N.J.S.A. 26:3-69 to 69.6). A copy of said code is annexed hereto and made a part hereof without inclusion of the text thereof herein.
The said code established and adopted by this ordinance is described and commonly known as the "Maintenance of Swine Code of New Jersey (1957)."
Three (3) copies of said Maintenance of Swine Code of New Jersey (1951) have been placed on file in the office of the Secretary, Clerk or other similar officer of this Board of Health upon the introduction of this ordinance and will remain on file in said office for the use and examination of the public.
No person shall maintain more than ten (10) swine, as defined in said code, on premises within the boundaries of this municipality until a valid (license) (permit) therefor shall have been issued by the Board of Health, except that persons now maintaining swine, as defined by said code shall not be obliged to obtain a (license) (permit) for one (1) year from the effective date of said code.
(Licenses) (Permits) required by this ordinance or code may be denied or suspended by this Board of Health for failure to comply with this ordinance or code. This Board of Health shall afford the person whose (license) (permit) to maintain swine on premises has been denied or suspended an opportunity to be heard in public hearing and, following this, to be informed of the Board's decision within two (2) weeks thereafter.

The fee for a (license) (permit) to maintain swine on premises shall be ten dollars ($10.).
(Licenses) (Permits) issued for the maintenance of swine on premises shall expire annually on the last day of each year, and application for renewal thereof shall be submitted, together with the required fee, prior to January 1 of each year.
A. 
Any person who violates or neglects to comply with any provision of this ordinance or code established herein or notice issued pursuant thereto shall, upon conviction thereof, be liable to a penalty of not less than five dollars ($5) nor more than five hundred dollars ($500) for each violation.
B. 
All ordinances, codes or parts of same inconsistent with any of the provisions of this ordinance and the code established hereunder are hereby repealed to the extent of such inconsistency.
C. 
In the event that any section, sentence or clause of this ordinance or code shall be declared unconstitutional or inconsistent with the provisions of any statute governing the maintenance of swine, including those of P.L. 1957, c. 140, by a court of competent jurisdiction, such declaration shall not in any manner prejudice the enforcement of the remaining provisions.
