No person, firm, or corporation shall build or allow to be built any outdoor fire within the Village except as set forth in Section 8.28.020. This prohibition on burning includes burning of construction waste and debris at construction sites.

A. 
Outdoor cooking over a fire contained in a device or structure designed for such use is permissible;
B. 
Controlled burning of grass, leaves, yardwaste or similar natural vegetation for environmental management purposes is permissible;
C. 
Ceremonial campfires, bonfires, are permissible;
D. 
All allowable open burning shall be monitored by a responsible adult person until the fire has been completely extinguished;
E. 
All allowable open burning shall be located at least 25 feet from any neighboring residence or structure;
F. 
All allowable open burning shall be located 25 feet from all structures, street right of ways and all combustible material;
G. 
All allowable open burning shall be in an open fire pit or manageable pile maintained in a safe hazard free manner.

A. 
No person, firm, or corporation shall burn or allow to be burned, garbage, rubbish, trash, debris, litter, recyclable material, and noxious or hazardous substances;
B. 
No burning shall be allowed in burning barrels or any like containers;
C. 
No burning shall be allowed upon any street, sidewalk, curb, gutter or ditch within the Village;
D. 
No burning shall be allowed during excessive wind or atmospheric conditions or local circumstances that may make such fires hazardous;
E. 
Outdoor Solid Fuel Heating Device. An outdoor device, structure, building or apparatus which supplies direct or indirect heat from the burning of solid fuel, including but not limited to wood, to another building. Outdoor solid fuel heating devices are prohibited and shall not be installed or operated within the Village of Darien;
F. 
Outdoor Wood Burning Furnaces. Includes accessory structure or appliance designed for a location ordinarily outside the principal structure and used to transfer or provide heat via liquid or other means, burning wood or other solid fuels, for heating any principal or accessory structure on the premises. Does not include recreational fire, barbecues, fryers, or chimneys.

Any person, firm, or corporation utilizing and or maintaining outdoor fires shall be responsible for all damages, and costs involved resulting from open burning.

Any person, firm or corporation, or any officers of any corporation, who shall violate or cause to be violated any section of this chapter shall be subject to a penalty as provided in Chapter 1.08 of this Municipal Code.
