A. 
No private driveway or culvert emanating from, adjoining, or abutting with or upon a public street within the Village used as ingress and egress to and from privately owned lands, shall be installed, until a permit therefor has been obtained by the owner, or his or her authorized agent from the building and zoning department.
B. 
The Village Board shall order the alteration of or reconstruction of any existing private driveway (May 5, 1953) if, in its judgment such driveway interferes with proper drainage of surface waters along any street in the Village, or interferes with drainage of surface waters so as to be damaging to a street within the Village.
C. 
The required driveway/culvert permit shall be subject to the following restrictions:
1. 
The applicant represents all parties in interest, and that any driveway or approach constructed is for the bona fide purpose of securing access to property and not for the purpose of parking or servicing vehicles, or for advertising, storage or merchandising of products on the street, alley or highway right-of-way.
2. 
The permittee shall furnish all materials, do all work, and pay all costs in connection with the construction and maintenance of the driveway and appearances on the right-of-way, street, alley or highway surfaces, shoulders, ditches, curb and gutter. Vegetation disturbed shall be restored to original condition by applicant and is subject to approval by the Village department of public works or by the building/zoning department.
3. 
No revisions or additions shall be made to the driveway or its appearance on the right-of-way without written permission from the department of public works or building/zoning department.
4. 
The applicant, subcontractors or owners, agree to hold harmless the Village and its duly appointed agents and employees against any action for personal injury or property damage sustained by reason of the exercise of this permit. The applicant shall be responsible to notify Digger's Hot Line and to comply with any directives.
5. 
The department of public works does not assume any responsibility for the removal or clearance of snow, sleet or ice upon any portion of any driveway or entrance along any roadway, alley or highway, even though snow, ice and sleet is deposited on the driveway or entrance by its authorized representatives engaged in normal winter maintenance operations.
6. 
Installation of driveways, approaches and culverts shall be in compliance with the Village of Darien Municipal Code, Village "Designs Standards and Construction Specifications" and all adopted Wisconsin State Statutes.
7. 
The required driveway/culvert permit must be applied for and approved prior to installation by the Village building/zoning department.
8. 
The fee for such permit shall be $25.
9. 
Upon determination of the building/zoning department or the department of public works, a refundable road bond of $300 may be required. A refund shall be available 30 days after completion of installation and final inspection.
