A. It shall be the duty of the Zoning Officer or duly appointed person
acting in his stead, to administer and enforce the zoning provisions
of this chapter. It shall be the duty of the Zoning Officer to issue
a violation to any individual, partnership, corporation or other entity
commencing any construction or other activity related thereto (not
that activity as authorized by a building and zoning permit) authorized
under any permit issued by a Federal, State or county entity or agency
until copies of said permits or authorizations are filed with the
Construction Code Official and the Zoning Officer of Barnegat Township.
B. It shall be the duty of the Construction Code Official, or duly appointed
person acting in his stead, to administer and enforce the remaining
provisions of this chapter.
C. No building permit shall be issued unless the plans are accompanied
by an approved development permit. No development permit shall be
issued unless the proposed structure, use, temporary activity and
construction activities are in compliance with this chapter. In cases
involving the new use of an existing structure, no certificate of
occupancy for the new tenant shall be issued until a development permit
has been issued.
D. During the first three (3) months of each calendar year, the Planning
Board shall review all approved major subdivisions and all approved
site plans where the improvements required by the approving agency
have not been completed and/or the posted performance guarantees have
not been released. Each major subdivision or site plan shall be reviewed
as to (1) satisfactory progress of development; (2) compliance with
all conditions of approval; (3) compliance with all Township ordinances;
and (4) such other matters as the Planning Board shall deem relevant.
The said Board shall make written findings. A copy of said findings,
and any recommendations, shall be forwarded to the Construction Official,
Zoning Officer and the Township Committee.
